I think if you recreate the track you still have to pay some kind of royalties to the composer, but not to the licenser of the recording. If you listen to both it is a recreation. This song is 1999 in 2001 The Avalanches had there album delayed because 'they' had sampled Madonna on the track 'stay another season, which became famous when she finally ok ed it for the first sampled Madonna song, It was Holiday

Actually the song your referring to was conceived in 2003.

Annie had already done this song in 1999. So if anything, Annie was ripped off.
