The President, the Secretary of Defence, among others, do have the authority to determine who are enemies of the US and order action against them. They're not immune from the law, but they do have legal cover for the more unsavory aspects of what their jobs require of them.

As to the NSA of 47, I think the creation of the CIA was a good thing, but can argue against merging SEC of Navy and War into Defense and separating the Air Force from the Army. On sides, I suggest the question is how to better approach the war on terror; from a police/lawyer or intelligence/military perspective. I say the latter.
