Fish is the top source of DHA, the best way to improve brain health. Coal, even without these spills, is the top source of Arsenic and Mercury. Mercury that gets into fish, so little of it is safe. Mercury that does what? Brain damage. Coal has brutally destroyed so much of rural America. Some of the poorest folks are families of the workers in coal who were abandoned when it left town. Many of them have ancesters that were the founders of this nation. They deserve a voice.

I have an idea, boycott TVA! So unplug your computer right now and go turn your lights off. I bet if everybody did it for 30 days (lived in the dark) that would really show them! I also wonder if the reason you were not seeing clean up was because there were some people in boats that were in harms way so they stopped the clean up until they got you to safety!

I will gladly turn off any coal electric source when technology is in place that allows the use of sustainable power. Which is more idiotic, Telling the truth or TVA arresting people involved in a humanitarian act? I was detained by the rent-a-cops of TVA and told I would go to jail if I came back to give drinking water to people who has asked for it.

When we went in to get samples, they came after us with cars, boats and even helicopters. You would think we were terrorists coming after the fact to get samples of the spill. Had we not, TVA lie of "Everything is safe" would still be the story.

BrownTown5555: While an individual or corporation may own the land in which the river flows over, it does not own the river or its water. The only way you can be charged with trespassing, or removed, is if you step foot on the actual physical land. You can not be removed if you, or your craft, is entirely in the water.

TVA isn't an individual or corporation, its a US government agency. I'm not sure how exactly this changes things, but TVA is the federal government, and the state and local government is also here, so who does or does not have the right to control this water?

This was not a private pond. It has buoys for barge navigation, public landings, and there were NO USCG signs posting the river for public use. Other boats were allowed in, as documented by NY Times videographers. We were detained because we were taking samples that have now proven Arsenic at 300 times the safe allowable limits.

Simply put, we were not trespassing. We were being harassed for exposing TVAs negligence.

I agree, you are most likely on TVA property. Just because a body of water joins a river that doesnt mean that every citizen has a right to be on it.

Example, If I have a pond on my property that has a spill way. Lets say the spill way ajoins the TN river. Does that give everybody a right to access my pond via the spillway?

If you want to contest that, just grab a map of the TN river. It will show you the national waterway boundries. there are a lot of coves that are private property

And that legal standpoint is what needs challenged. No such agreement exists anywhere else. It is as if TVA asserts ownership of the water which it does not have. That is a waterway of the U.S.

At no time did we get out of our boats not did we set foot on TVA land.

TVA owns all the rivers and reservoirs up to a certain elevation which the person in the video is almost certainly standing in. Even if you never set foot on land they still own the "land" under the rivers and LEGALLY they can kick someone out.

I'm not saying anyones right or wrong here, I'm just saying that I'm pretty sure they have their ass covered here from a legal standpoint.

TVA owns the land in question, you have no constitutional right to go on lands owned by TVA just as you have no right to go to a USA army base, or even your neighbors yard.

Part of the reason they are probably keeping people out is for their own protection. If someone goes to this area taking pictures and then somehow gets sick or injured TVA would probably be held liable even though the person was trespassing illegally.
