TVA isn't an individual or corporation, its a US government agency. I'm not sure how exactly this changes things, but TVA is the federal government, and the state and local government is also here, so who does or does not have the right to control this water?

Other boats were allowed in, as documented by NY Times videographers. We were detained because we were taking samples that have now proven Arsenic at 300 times the safe allowable limits.
Simply put, we were not trespassing. We were being harassed for exposing TVAs negligence.

And that legal standpoint is what needs challenged. No such agreement exists anywhere else. It is as if TVA asserts ownership of the water which it does not have. That is a waterway of the U.S.
TVA owns all the rivers and reservoirs up to a certain elevation which the person in the video is almost certainly standing in. Even if you never set foot on land they still own the "land" under the rivers and LEGALLY they can kick someone out.
I'm not saying anyones right or wrong here, I'm just saying that I'm pretty sure they have their ass covered here from a legal standpoint.
TVA owns the land in question, you have no constitutional right to go on lands owned by TVA just as you have no right to go to a USA army base, or even your neighbors yard.
Part of the reason they are probably keeping people out is for their own protection. If someone goes to this area taking pictures and then somehow gets sick or injured TVA would probably be held liable even though the person was trespassing illegally.
