Because government employees (Presidents) are not interested in a Court that would limit government power. What President wants a court that would limit his power, agenda, ego?

People see the Supreme Court as somehow standing against government excess. The Court is part of the government, nominated by and approved by and paid by power-hungry politicians. The judges are the same people, in essence, as the politicos.

The man is right, but I don't see a line of people or lawyers putting this before the Supreme Court. Until someone does, it won't make any difference and as long as the Court decides that the Constitution is "flexible" it doesn't make any difference.

The Supreme Court routinely sides with increasing federal power, opting for the meaningless Living Constitution over the written one. Sodomayor is just a continuation of that policy. Don't forget the Supreme Court is just another arm of the federal government.
