Well in true Sharia law the husband should produce 4 reliable witnesses who "witnessed" the act or her having extra-marital sex, if one of those witnesses was found to be lacking (in reliability) he (the husband) would be severely punished for slander. So, I don't see how this could be called an incident of Sharia Law taking place.

Now, if the victim of rape comes forward claiming she was raped, whats to stop the many people who raped her from claiming she is an adulterer and she been stoned to death because SHE can't provide the same number of witnesses to counter their claim? I do a google search for sharia, specifically looking for sharia related sites and there is no mention of punishments relating to homosexuality etc. Why? If they actually admitted that killing was the punishment, the website would be shut down, now wouldn't it. Hard to find proof aside from news articles documenting pubic floggings, stonings and removal of limbs. I think that classes as proof of its barbarity though, don't you?

1- The tax was averaged at 2 dinars per year per "capable" male
2- The money was returned at times when Muslims deemed they would not be able to hold their ground against attacking armies.

1- The amount being stolen is substantial and it is stipulated in Islamic law.
2- The state has already seen to that the people are well off and provided for, it is wavered in times of famine and economical depression, or if the thief is actually in deep need like trying to feed his family.
You just know the punishment but nothing about when it is enforced.

Well in true Sharia law the husband should produce 4 reliable witnesses who "witnessed" the act or her having extra-marital sex, if one of those witnesses was found to be lacking (in reliability) he (the husband) would be severely punished for slander. So, I don't see how this could be called an incident of Sharia Law taking place.

Its actually the other way round. The woman requires four reliable MALE witnesses if she claims she is raped, lest she be punished and charged with adultery. Men have FAR more rights wiith regard to sharia law than women do. Sharia law is barbaric and archaic. I didn't call you a liar, I said what you said was a lie, if you "invented" that lie, then yes, you'd be a liar, or you could be just repeating the lie propagated by others, in which case you just didn't do your homework in verifying the information.

But basically, this document is providing an outlet for the perpetrators of rape to turn the crime back around on the victim (especially if there are four or more people involved). What man rapes a woman infront of four neutral witnesses?
She reports the crime, the rapists testify that she was an adultress, she is punished with stoning or whipping. Not a nice outcome for a victim of rape.

@FannyFarty - I just sent you a link to a site responding to the claim that rape victims need to produce witnesses - I think it pretty much refutes it. Let me know what you think. As for the Pakistan document, let me know if I'm missing something, but I didn't see anything in there about rape - I could have missed it or a link to it. Let me know.

Zina itself means extramarital sex (sex before marriage). Four people need to be provided to prove this happened. Now, if the victim of rape comes forward claiming she was raped, whats to stop the many people who raped her from claiming she is an adulterer and she been stoned to death because SHE can't provide the same number of witnesses to counter their claim? Thats what I was getting at. This article proves that sharia law has a bias towards women by stating that the witnesses must be men.

And furthermore, the scenerio I gave has happens time and time again in countries where sharia is law. The victim is often in an catch 22 situation if she reports the rape, she runs the risk of being accused of Zina, if she does not, her possible pregnancy may result in her being charged of zina anyway.
How can you believe that this law is anything other than grossly unjust and open to exploitation in the mans favour?

@FannyFarty - "the scenerio I gave has happens time and time again" because of ignorance, that is just vigilante justice (or rather injustice), it has no barring on what Islamic law actually stipulates. The truth of the matter is there is no country currently correctly enforcing Islamic law. We're at an age were people are deviating from Islamic teaching not the other way around.

You're right in the fact that it has no bearing on islamic law, HOWEVER it is islamic law that allows for this loophole to begin with, given that the laws in these places are based on islamic law.

Well, I don't think you're a Christian, but still Christianity too was once knee deep in bloodshed and oppression, now they are herald as the epitome of peace and love. Every ideology has the potential to be misinterpreted and turned into something ugly - and Islam is no different. It's a sign of the times we live in, If memory serves me, during the first couple of centuries of Islam there was only one cause of punishment enforced for adultery (proven by confession). cont

Every Islamic law back in the day proved it's worth to society when it was enforced correctly with the right prerequisites. For instance the "cutting of the hands" of thieves that is so mocked today should only be applied after society has been provided for and people have no need of stealing to provide for their families, and even then not for stealing an apple of a loaf of bread, and it's waived in times of depression and famine etc... For Islamic Sharia law to make sense you don't take each law separately , you need to view the entire Sharia as a whole, You don't punish fornicators before you deal with the underlying problems leading to them, you don't cut the hands of thieves until you've fed the people etc... This is what Muslims have against those speaking against Sharia, they take every law as if its a separate entity and with no context.

I'm against what Muslims do in the name of Islam just as much as you, and all the Muslims in my society feel the same - I have Muslim friend who are activists against the inhumanity against women done in the name of Islam, but that doesn't mean that we don't get frustrated when a non-Muslim makes it sound as if Islam and all Muslims treat women in that way.
