The reason why Nick Fury is black here is because he's not the ORIGINAL Colonel Nicholas Joseph "Nick" Fury created in 1963, it's because this one is Marvel's Ultimate Universe's version of Nick Fury. Before Marvel made a reinterpretation of the character, Jackson gave his consent for Marvel to design their "Ultimate" version of Nick Fury after his likeness for the next comics, which is why in 2008, he was actually able to get his part as General Nick Fury in Iron Man.

Well, you don't have to worry about Jackson anymore. Samuel L. Jackson has inked an unprecedented nine-picture deal with Marvel Studios to portray Nick Fury again. Jackson, who was apparently at odds over his role just a few weeks ago, is now locked in to appear as Fury in Iron Man 2, Thor, The First Avenger: Captain America, The Avengers & those films' sequels.
