  • @Adropacrich2 I wouldn't say Timbaland did anything clever in this case, but generally I think this should be allowed as long as the original composer is credited. It is perfectly possible to create a original song by sampling, cutting, pasting and looping parts of other works.

    My only real issue with this is that he claims he did the song himself, made up a story about playing a game with this music as a kid, and then sues every last penny out of anybody who would do the same with his music.

  • I'm not as shocked as many of his fans that he clearly ripped this from somebody. Many producers have many other things in mind than music which distract them from creativity. The two video responses above tell tell the truth about the difference between sampling and stealing. Even Timberland himself tells you the difference even though he claims that it's from a video game. The court will ask, "who produced the music in that game and what game is it".

  • the first file being played is a midi file... you can download them for most songs... most midi files played in media players all sound the same because the multitracks all use the same synth to reproduce the original song... where as in any production program you can listen to each midi piece as a different instrument...(this is basics to audio production 101) the only similarity's in both the songs is the high hats replicated within the midi file...

  • This is possibly one of the greatest comments I've ever seen on the definition of the word sampling. I commend you sir. As a breakcore artist, I sample A LOT of stuff. Drums, Vocals, Instruments etc. But I almost NEVER leave it as is. I always slice it up, and mangle it in some way. What Timbaland did here is a disgrace to the music industry.

  • Yes Hip Hop is made from samples like all other big hits. But what they did is credit the original writers. I'm sure Stevie Wonder got money from Coolio Gangsta's Paradise and he was credited aswell. There is a risk that we all take when we sample other material if we don't credit them and must face the consequences if there is an issue. EVERYONE PLEASE TAKE NOTE OF THIS BEFORE YOU START PRODUCING OFF RIPPED MATERIAL.

    By the way this isn't aimed at you but my opinion to the answer you gave.

  • Also a similar thing happened with Zombi Nation by Kernkraft 400 when they ripped the idea from a C64 game called Lazy Jones. Originally unlicensed, they paid an undisclosed fee. They didn't sample it, just taken the melody and had to pay out for it. Timbaland can say "it's from a computer game frikin jerk" but so was Zombi Nation. Computer game music is not exempt from being real music because it's part of a game. If that's the case then all current game music can be ripped without consequences

  • If anyone still thinks that what Timbaland did was fine, take a look at what Vanilla Ice did with Ice Ice Baby. He "just taken the bassline" from Queen & David Bowie - Under pressure and released it as his own without crediting them. This changed later when they went to press charges. I guess that you have got to have money to protect your music art in this world. For those unfortunate to fund court proceedings, name and same is the best we can do.

    And if he would have the permission, why is he being sued by the finnish song maker and the norwegian C64 version maker (who by the way did the version with an actual permission).

    If he is as big and as good as everyone seems to think, wouldn't he have the talent to create something new, own and not copied?

    The thing is that he used the entire piece on his song, did not tell the original author he is using it, and no royalties have been paid. There is no agreement of any kind between the two.

    He just simply stole the tune and probably figured he could get away with it. The guy is an asshole basically.

    Anyhow the song did become quite popular and thus he did make money on it. Even if he was quite well off to begin with doesn't change the fact that this is theft.

    The rich keep getting richer by stealing where they can, and that is ok ... because? All that was required was to give proper credit and compensation to the original author.

  • I feel that if Timbaland had or even would credit the original artist/producer with being the main/total inspiration behind Timbaland's own work.     producers can sample someones music to create something original, but when you sample an ENTIRE melody, loop it and put drums on top, and call it your own its stealing (cos its not exactly original is it?), if an average joe went on fruityloops and put some drums over the titanic theme and tried to sell it as an original what would you think? timbaland does the exact same thing with less famous samples, therefore hes stealing.
