What I got from reading the CURRENT State of California Attorney General's "amicus curiae" brief in THIS case (entirely) is that California STATE law is still something of a MESS, which can't possibly help the situation EITHER WAY in the long term, in my opinion. I ALSO fully agree with Judge Walker's legal CONCLUSION (I won't get in-2 all the findings of fact HERE, though). But this Standing to Appeal thing is really messing up the whole case, IMHO. Anyway, the California Court WILL rule...
But those of us fighting for equality, who could legitimately feel despair over having had our constitutional rights taken away by our fellow voters, greet each other with hugs, with kisses, with happiness. We stand together in clumps, exuding friendliness and love. it's subtle, but it really shows where the love is, and where the hate is, in this fight.

While I disagree with the prob 8 supporters, they do have the right to defend the law in court. Technically Jerry Brown and Arnold Schwarzenegger broke their oath of office by not defending the law. Overall this hole thing is silly, we could have easily overturn this law last November.

Second, Prop 8 supporters were not harmed in any way by the law being found unconstitutional, or by same-sex couples marrying in their state. In federal court, you can't defend a law unless that law prevents some harm done to you.

One of many reasons is budgetary concerns. If the AG sees that the case is likely to lose in court, wasting taxpayer dollars, it's in everyone's best interest to NOT defend the law or file an appeal. Look it up, it's quite common for the state to refuse to defend or file an appeal.

I will support and defend the Constitution of the United States and the Constitution of the State of California... " .
