I hate when ppl start that crap saying we all need to go back to our country. This man does not speak for everyone . I made a good life for my kids and I proudly serve and love every moment of it. He needs to accept personal responsiblity and quit whinning.

And further more he is not even Jamaicn he is from Trinidad stop lumping all foreigners together and viewing us as criminals. Some of us actually come here and live a honest life without engaging in criminal actiivity.

there are 2.2 million americans in jail today do you want them deported too? America has 5% of the worlds population but 25% of the worlds inmates. Imigrants are not the problem its our society and our get money mentality
True but we as a Nation that fought & died for freedom should know better. In my opinion any "legall" immigrants that is willing to serve & protect our nations freedom with their life should become a Citizen. There is a big difference between a "legall" Immigrant who came to this country for freedom & a better life than a "legall immigrant who came to detroy it. In WWII the most decorated unit in the US ARMY are not even black or white. They were Japanese Americans who fought in secret because..
How can you deport a US war veteran? Easy. You commit a crime. You`re a greencard holder and have you applied for naturalization at anytime prior commmitting a crime? Citizenship is not automatic, unless you are born here in the US. I have been here in the US for more than 20 years, served in the gulf war like you, and retired US Navy. Up until now I am not even a legal US resident. Going to jail is one thing I dont like to happen to me to end up just like you.
Why am I not yet a US citizen? Been looking statutes and intepretations on USCIS website and have yet to find one that would even grant me a greencard as a US gulf war veteran.
Armed Forces Immigration Act of 1991 is not applicable to me.
Hmmm This reminds me of a bill in congress, the Dream Act which would allow children who came here before the age of 16 and served in the military or finished a bachelors perment status. I wonder if this person would be able to benefit from this law.
to commit a crime or major crime then serve in the millitary and asume that the crimes will be forgotin and or dismissed is completely insain . that would like if i killed any of your family mimber deliberatly and serve in the military and say all my crimes are foregiven people that would take that aproche has never been efected by a crime against them .
i need to ask ,if an individual man from a nother country raped your daughters ,served prison time , then served in the milatary . would you want him to beable to stay in the U.S to be able to rape againwit more deadly force that the milatary had taught him or deport him back to the country that he came from .
Watch, It is still very misleading foreigners to allow them to serve in the military and then kick them in the butt and say they are not citizens. Plus, we are not sure if he raped someone or not. By the way, I am not aware of any citizen having their citizenship revoked for rape or any other crime. We do it to immigrants b/c they're voulnerable. We need to apply the law equally. If we throw this man out b/c of his crime than we need to deport everyone who comes out of prison.
No one is safe in America from bigotry. To say that he is a criminal is bigotry against a person that is no longer a criminal because he served his time and so his record is supposed to be wiped clean! It is unconstitutional for a person to be penalized twice for the same crime!
The deportation laws that have been recently enacted by a ignorant a
while I will say "thank you for your service to this country", I also have to say that if you are indeed a convicted felon, that is reason for denying your citizenship. There are already plenty of felons here, and bringing more in does nothing for the positive of this country.
I don't think that was the point. He was presumed to be a citizen after doing military service. The real question is; did we kick out a citizen or a foreigner. Based on this video we kicked out a citizen. (((What has been done to him IS A BIGGER CRIME than what this gentleman did)))
presuming that you are a citizen is NOT the same thing as being a citizen. Like I said previously, I thank him for his service to this country, however while serving military duty is a "fasttrack" to citizenship, it does not guarantee citizenship. There are other things that go into consideration, such as criminal background. and according to this video we don't know what crimes were committed. regardless of time spent in prison, once a convicted felon, always a convicted felon.
Sorry but we just disagree! The military really made a big boo-boo by allowing a foreigner to serve in the military. I believe that the "citizenship issue" was very misleading and confusing. If he served in the military he should be a citizen. There are alot of people that I would like to kick out of the U.S. but the fact is they are citizens. (It is the same principle with family; Family is family regardless of whether you like them or not).
Actually, INA § 101; 8 USC § 1101 defines "national" to be a "person who has permanent allegiance to the US." Serving in the Armed Forces does show permanent allegiance. And, of course, only aliens can be deported. An "alien" is defined to be a person who is neither a citizen nor a national. However, 2nd Circuit Court of Appeals recently rejected this argument. They held that only people who are born on the US territories are nationals.
And, by the way, this guy in the video was a lawful permanent resident (LPR, green card holder). I was there at the conference at NUY Law School where he talked on this video. I believe he was detained by immigration for almost 4 years of "civil" incarceration fighting his deportation. He would have had a better chance if he would have stayed in his resident state, New York, but ICE (formerly INS) has a complete discretion to transfer detainees out of their home states.
His case was actually accepted by a New York federal court. But subsequently to the retroactive application of Real ID Act of 2005 it was transferred back to Louisiana-based 5th U.S. Circuit Court of Appeals.
Prior to Real ID immigrants could challenge their deportation in a federal court of their "residence" through a habeas writ. Now they can only seek judicial review in the state where ICE (formerly INS) decides to transfer and detain them.
The Real-ID was rejected 3 times in Senate. Only reason it passed was because Sen. James Sensenbrenner attached it as a "rider act" to an Emergency Military Budget Bill for Iraq. This was published on Wikipedia but seems to have been removed.
I am also curious, what was the US Congress doing passing harsh anti-terrorism laws against "legal" green card holding immigrants and almost 5 years before 9-11. 1996 "AADPA" Act was passed at one year anniversary of Oklahoma bombing. But that was done by a white, US born, war veteran. He wasn't even an immigrant. What was going on?
Check the timing of the first Twin Towers attack by immigrant terrorists and you will find your answer. The law was not brought about by the Oklahoma City bombing.
That is a falsehood tossed out by those who wish to cloud the issue. Have you noted that almost all of the terrorists who attached on 9-11 entered legally and at the time of the attacks were in violation of conditions of their entrance permission? Ignoring immigration violations has cost us dearly!
Simply thinking this man for his service and for risking his life is not enough. It is an insult to him and it is an insult to us for allowing it to happen.
like I said, I am very grateful for his service, however, he probably shouldn't have been allowed to serve in the first place. I don't know what his crimes were, the video didn't say, but, there are rules to follow, as unfair as they may be, but if rules are not followed then you have anarchy. he was not a citizen. Do I think he should be given differential treatment because of his millitary service? I don't know all the facts behind his case and can only offer an opinion based on facts at hand.
Jenrob, this is the problem there is not many facts at hand based on this video. The video implied that he was detained without due process. He could have gone to jail for anything from a mistermeanor to a murder. I don't know. However, I ussually error on the side of presumed innocence and not guilt. The fact that we let foreigners serve in the military is very disturbing and I can understand him being mislead.
A few seconds of searching found this from breakthrough tv: Anslem Ifill is a Legal Permanent Resident from Trinidad and Tobago. After living in the United States for 25 years, it is his home. So much so that he put his own life at risk to serve this country for eight years with the U.S Army, including the first Gulf War.
Upon returning he committed a crime and served out his sentence. Instead of being released he was detained for several years and now faces deportation.
he had said that he was here sence he was three , comitted crimes ,served prison time , then served in the service . now we are finnished with you sence you did not get killed in the milatary you can go back to your real home that your family ilegaly came from for the illigal actions you also commited.
Can you deport someone after they have pledged allegiance to the U.S? Sounds fishy and illegal.
