  • about a month ago I visited a few relatives in Florida and I found a bar about a quarter mile away from their house. I walked there and it feels like going back in time. The bar sells drinks and food and allows smoking! Enjoying that would be illegal in more than 30 states.

  • Let the free market decide if smoking should be allowed in bars. If the bars that don't allow smoking, go out of business, then we have our answer.

  • this is yet ANOTHER example where the govt creates a problem through legislation and then tries to solve it with more legislation. the initial problem is all the licensing which artificially restricts the supply of bars. remove that, and you'll naturally have smoking AND non smoking bars as bar owners compete to satisfy the varying preferences of consumers. believe it or not the "solution" for everything doesn't have to be govt "laws" combined with threats of guns and cages.

If you are is addicted to nicotine, buy some gum or get a patch but don't force me to deal with the side-effects and health consequences of your nasty habits in public. You have to go to a firing range to shoot guns, you should have to go to a smoking lounge to smoke tobacco. I'd like to go to a bar to have a drink and not have to suffer for habits I don't have.

  • @AynRKey This is why I patronize bars in Illinois: People are 'invited' to go outside to smoke, and (usually) the bar owner provides a heated and sheltered outdoor space for this activity; patrons welcomed back in when they are done. I have no problems associating with fellow patrons in the bar, as long as they are not actively smoking. Likewise, urinating, spitting and defecating -- there is an appropriate time and a place for everything that causes a health hazard to others.

And do you know what you also have the right to do? Not visit a bar that allows smoking. You could also request to go to the non-smoking section of a restaurant, which are pretty good areas to go to, if one wishes to not smell cigarettes.

  • Well some bar owners don't mind that you smoke inside their establishment, it would then be your problem. Sure, you can argue that it is not a big deal to simply smoke outside for a minute but it is equally no problem for you to go to another place.

    No one in a bar is being FORCED to do anything. They may choose to not enter the bar, or to find a bar which privately chooses to be a non-smoking establishment.

    As free people we should have the right to choose to enter such premises if we so desire.

    And as a capitalist economy, bar owners should have the right to either allow or ban smoking in their bars themselves, if they think the decision will improve business.

  • @palatiality By that reasoning, loud music should be banned for damaging ears, all drugs (including alcohol) which may impair the ability to drive, cell phones, radio, eating, drinking, texting, and talking should all be banned from cars as well because they can all lead to reckless driving. Where do you draw the line? The easiest and most fair thing is to let people choose where they want to go-smoke free places, or smoker's places.

  • @chri5784 None of the bars and restaurants mentioned could be considered public spaces. They are all private, which is why they can bar lawmakers from patronizing them, just like they could bar any other non-protected class, such as left-handed people. These bars/restaurants are private property where smoking is banned, ergo smoking could be banned in private places, such as your home. Not saying it WILL happen, but these days I hesitate to speculate where things will be banned next.

I was thinking that I was fine with people smoking in bars because I have a choice not to go...but then I was wondering what would stop most business owners from allowing smoking to boost their own profits. That really would suck for those of us who don't want to be around it as it's not like the health risks are any secret. So yeah, I think the "private" thing is a good alternative. Hopefully it would be doable, affordable, etc.

And you'd think that if their businesses are struggling, banning potential customers is a really dumb idea. Maybe their recent struggles have more to do with the economy and their poor business decisions than a smoking ban that most people supported.

I also forgot skin cancer, so everyone should be required to wear wide brimmed hats and long sleeved shirts during daylight hours...except that people require Vitamin D so scheduled sunlight exposure schedules will be issued. There are places in Japan that you're not even allowed to walk down the street and smoke. I don't want to breathe your filth! Can't wait until they do it in apartment buildings, too.

Kissing certainly serves no purpose and can spread the flu, which can be fatal. All coughing people should be placed in quarantine. In fact face masks ought to be mandated, along with latex gloves. Violators should be imprisoned. Just imagine how much healthier everyone would be!

  • The bars/restaurants in my area are booming. When they smelled of smoke

    responsible people would NOT subject their families to that atmosphere. A license to serve alcohol is just that...it's not a license to subject others to a PROVEN health risk.

  • @hackley111 #1 a business owner should be allowed to control what happens in their own premises. If smoking is legal in their state, they should be allowed to decide if they wish to allow smoking in their establishment. If they want allow smoking, so be it. You don't like it? Don't go there.

  • @hackley111 The bars aren't subjecting people to anything. It is the smokers who are subjecting others to their smoke. But the smokers are also customers. If a customer subjects another customer to smoking, that is a matter between those two people and maybe the bar - not the state. The offended person should complain to the smoker, complain to the staff, and if they are unsatisfied, leave.

  • I'm split on the smoking ban. It's private property so I think the owner should be able to decide what happens in their own property. But the health risks are very high for passive smoking, especially if you spend a lot of time in bars or pubs and as a non-smoker I never appreciated coming home smelling of smoke and my skin feeling sticky with tobacco, yuck.

    Lastly however, the customers will come back to the pubs eventually. What has happened in the UK is we have more people smoking outside.

    And the reason why there aren't any non smoking bars in areas where it's still legal is because of the ban in the first place.

  • @mariotaz I don't give a damn if someone has a habit that affects others because one has to voluntarily enter one of these establishments which are known for allowing smoking. It is their life and therefore not my business nor the business of the government. Some people like to smoke while they drink with their friends, some people smoke in pubs BECAUSE they don't want to smoke at home, in the car or outdoors. You are assuming your lifestyle should trump others, even in private settings.

  • In Brazil we have a similar law that in the state of São Paulo you can't smoke inside any establishments. In the beggining was kinda bad for bussiness, but now, the people just love it. Now you dont go to a restaurant or a bar and go out smelling nicotine if you dont smoke.

    because, come on, even separating the areas we breathe the smoke of other people, cuz most part of the time its a "virtual" division between them.

  • In my town of Tallahassee (capital of Florida) they just passed a law that requires you to bring your garbage can in from the road within 24 hours or face a fine and automatic enrollment of curbside service.

Restrict their ability to choose and see how they like it when the the only place that can shop is big chain stores. See Obama & Boehner shop at Wal-Mart.

  • I live in Michigan and I can tell you exactly how bad this is. The average person does not want smoking banned. Bars are often completely empty. The other day I went into the Post Bar, a place I hadn't been to since the ban, and my family and I were literally one of just 3 groups of customers there.

I said to the bartender "so they finally did it?" he said "Yup, and business totally sucks!" I went into a bar in Illinois I used to go to, about 1/3 the people. I went to a bar in Wisonsin after they did it, place used to be packed. There were like 6-7 ppl in there. Of course, the nannies lied "it won't affect business", I say BS.

Since a nanny is not strictly a government official or employee imposing an unreasonable regulation (that's my definition), how do you libertarians define "nanny" because this video just confused the supposed definition at best or widened the definition to anyone who chooses not to associate with anyone else at worst.

  • @warpedwiselegoman It's gotta hurt. You have to do something in order to get their attention. Banning law enforcement, firemen, and others who work for the state must be made to suffer for their mistakes.

    Think about it. When govt. does such things it hurts everyone. So, punish them back. All of them. Treat them all as their leaders and lawmakers treat you. Or, charge them more more money. They have to pay triple.

    If most businesses did that in a community, especially grocers, you'll see police and firemen complain about that up the chain of command. Sheriff's offices have a lot of clout with lawmakers - and what's more the press would get involved.

  • @warpedwiselegoman You have to understand that most of these civil servants, who are generally unaffected by the laws the legislators impose on others, are members of public unions who routinely donate money to politicians. If you show first hand what bad laws do by imposing a similar ban on them as well as the legislators, that would be a bit more effective because money talks louder than votes.

    If you do it right, you can get the press on your side too.

Cops don't, typically, protect people (nor do they even have a legal duty to intervene, according to the supreme court). On guilt: it's guilt by association with other police, who in the course of their jobs, do horrible things to innocent people under the theory of "victimless crime". And typically direct guilt. Before you pull the nuremberg defense, just don't. Doesn't fly with me.
