    At the very least I would like them to acknowledge that it's a shaky legal area. They don't seem to understand.

Plaintiff mentioned he wants cheaper games instead of paying the expensive price for them, defendant mentions the purpose of the chip is to 'allow' you to play free games which implies you're not normally 'allowed' to play those games. If some guy was suing someone for stealing his marijuana and took it to court I'd be amused.

These guys are fucking idiots, we can rightfully assume that they were not playing homebrew, but retail games. But regardless, that's a moot point. The chip itself is illegal federally per the DMCA due to its ability to circumvent copyright protection, regardless of if its being used to play legal games or not.

    1) It's not stealing, it's copyright infringement. Those aren't the same thing. Saying you're going to do something and actually doing it are two different things. In addition, they never said they are going to download retail games that would otherwise have to be bought. The burden of proof is on the accuser. Just because we all assuming they're going to pirate retail games in violation of copyright, doesn't mean they can be charged legally for it based on your evidence.

Thanks to Nintendos fantastic security system they cant really enforce it.
