As best I can tell, that's not Josh. One, it looks nothing like him... and two, he didn't join this band until February of 2008 - look at the date of this performance.
I did find it funny that the guitarist on the far right has Claudio-wannabe hair though.

its not josh at all. josh drums open hand and it doesnt look like him at his all. and its NOT his style.
