I put up a video of a lunar eclipse in Sydney on 27 Aug 07. My own work. It's a pretty boring subject, so to spark it up, have a bit of fun. I drew up a silhouette of the kid on the levitating BMX carrying ET through the sky and had this cross the lunar eclipse.

I can only guess it's because the end plate of my video was similar to the Amblin Television logo.

Someone on YT staff needs to be canned. They need to find out which mentally deficient staffer it is that wrongly flags and takes down videos that are inoffensive and appropriate. If the users lose faith in what's behind the scenes then that's a chunk of the value of the company gone. If decisions taken aren't seen as fair and right then trust is lost. YouTube supposedly offers a service, but recent events show a lack of good service.
I'm not a lawyer, but I've had to deal with this kind of thing as a server admin. It sounds like this was a DMCA copyright infringement notice that YT received. If that's the case, the law gives them 3 options:
1) take the offending material down.
2) If you file a counter-notification then they can leave the material up.
3) If they don't do #1 and you don't do #2 then they are as legally liable as you are to a lawsuit for copyright infringement. continued...

Yes. You are still obligated to file a counter DMCA on receipt, if you consider no infringement has taken place. Still, I'm thinking we should all stick that notice on the front our videos, along with a warning that those that engage in frivilous DMCA's will be subject to a nasty no holds barred campaign of YT account closure. They are in principle in violation of YT terms and conditions. If enough complaints stack up, the worst offenders should get booted. Non YT still a problem though.

I'm not a lawyer, but I've had to deal with this kind of thing as a server admin. It sounds like this was a DMCA copyright infringement notice that YT received. If that's the case, the law gives them 3 options:
1) take the offending material down.
2) If you file a counter-notification then they can leave the material up.
3) If they don't do #1 and you don't do #2 then they are as legally liable as you are to a lawsuit for copyright infringement. continued...

If you won't file a counter-claim for fear of legal action, why do you expect YT to go out on a limb and basically commit to defending (and possibly paying for) your alleged copyright infringement in a court case?
It seems to me that you should be complaining to Congress for passing the law, not YT for obeying it.

Until that happened, I did not know that ANYone can claim copyright violation, not just the owner or the licensing agent. I also did not know before this week that YT can close an account just for including a video among the favorites that somebody else created if that video violates the standards. I am a writer...and last effing time I checked ...

As has been prob said repeatedly, YouTube could fix the problems they are having with false copyright claims by requiring those asserting the claim to either place a monetary deposit (say 100$US) or send a registered letter from his/her/its attorney.
If the claim is not upheld-- give to the person whose video the case is about the $100.
If the claim is upheld, delete the account of the person who made the video.
Up the ante... that may do a bit to keep both sides honest.

Yes. You are still obligated to file a counter DMCA on receipt, if you consider no infringement has taken place. Still, I'm thinking we should all stick that notice on the front our videos, along with a warning that those that engage in frivilous DMCA's will be subject to a nasty no holds barred campaign of YT account closure. They are in principle in violation of YT terms and conditions. If enough complaints stack up, the worst offenders should get booted. Non YT still a problem though.

That YouTube will act on a DMCA against a YouTube member even when the DMCA is facially and/or transparently is very easy for YouTube to do. They probably think they are, indeed, very smart for setting up this procedure-- until a tipping point is reached, the regulars get pissed off and leave, and YouTube's traffic rankings take a massive nosedive, therefore destroying any notion that youtube will be the format of the future. Very smart indeed.

All I really have to say is that if you are removed, backing up the majority of your videos will help reinstate your position, and asking someone who is well watched (like AngryAussie) to put the word out on your new channel.
