Federal safety regulations prevent the driver of any commercial vehicle from having opened or UNOPENED alcohol in the vehicle. Penalty for violation is a fine and 24 hours out of service.
Federal regulations also prohibit:
• Consuming alcohol within four hours of going on duty;
or
• Consuming alcohol while on duty or being under the influence or having any measured alcohol concentration or any detected presence of alcohol while on duty.
