I did a U-Turn about a Kilometer or so before a checkpoint once as I saw a good gas price while driving by (It was late at night as well) a cop chased me alllll the way down from I don't even know where and tried to question me while I was filling up on gas. I had a beer and fully admitted to it, presented my license and where I live up to 0.02 you are scott free if you are over 21 and have full license, he just wasted about an hour of my time and his trying to prove I as drunk.
You would think living in the city of wine country it would be ok to drive around with a glass of wine tipping salutes to all you pass on the road lol
I was always taught that "driving is a priveledge not a right". Drivers ed class in high school, drivers training in summer school, and my parents all told me that. I strongly agree.
@henzolo: It's a way to instill the importance of understanding the responsibility behind operating a ton of machinery at high speeds around other people.
It's also mostly semantics. Rights can be taken away if there is just cause to do so. Privileges can be taken away on a whim.
It is a privilege. Have you been to a driver's course recently? they can check for sobriety whether want to. These checkpoints announced prior to the checkpoint date. If they feel you are intoxicated, they can order a test and if you refuse, there goes your driver's license. Are not discussing driving on private roads, we are discussing public roads. Private property you can drive naked if you want, as long as the owner doesn't mind.
@Oneness100: Well, you are welcome to call it a privilege, or a glazed donut. It's still a right.
I never said they can't check for sobriety.
You now say you are discussing public roads. Driving is a right on public roads, once a person procures the requirements necessary to do so. My right to travel cannot be revoked without just cause or only on a whim.
Sort-of semantics, but important. Saying that driving is a 'privilege' invokes the ability to deny it on a whim, which is not true.
@Pafoofnik1 no it isn't. God, or the state for which you reside in doesn't automatically grant people a driver's license at a certain age. You can APPLY for one, but that right, or priveledge, can be revoked for various reasons. As long as you pay your registration fees, or don't do something that the courts will revoke your license then you have a priveledge to drive. When i took driver's classes to get a ticket erased, EVERY instructor would tell the class that driving is a PRIVELEDGE.
@Pafoofnik1 whatever. The bottom line is that they only take away your driver's license if they have cause to do so. if you disregard the laws to KEEP your driver's license, then watch out. These DUI checkpoints are being done to check to see if you or anyone else is in violation of laws because they are a lot of DUI accidents for which people have been killed and organizations such as MADD and other political influences are trying to get people off the roads if they shouldn't be there.
@Oneness100 So you still agree with me that driving is a right.
I never said a thing about DUI checkpoints, but since you brought it up... It is unlawful for officers to "check to see if you or anyone else is in violation of laws" at a DUI checkpoint. (531 U.S. 32 (2000)).
@Pafoofnik1 no, i never agreed that driving is a "right', you are granted permission to drive once you have obtianed driver's license, etc., etc. But that license can be revoked, suspended, etc. if you aren't within the laws pertaining to driving. IF driving was a right, then you wouldn't need a driver's license.
@Pafoofnik1 that's a search and seizure to see if someone is smuggling drugs. This isn't a search and seizure situation. Be specific. if the primary purpose is to keep the roads safe, ie alcohol use, not proper registration, etc. This case looks like a search and seizure not a DUI checkpoint. I think if you read the case more carefuly, you'll find that checkpoints are legal if they are trying to see if people are driving drunk and in Napa, having wineries as their biggest product sold, etc.
@Pafoofnik1 DUI checkpoints aren't. Actually, i think they can search and seize at those checkpoints that trucks have to go to and at borders for contraband. But DUI checkpoints aren't illegal, which is what this video is showing.
@Pafoofnik1 well, this video isn't of a drug checkpoint, then why did you bring it up in the first place if the video is of a DUI checkpoint? They are arresting people for drinking and driving.
@Pafoofnik1 yes, well if they are drunk, then they are in violation. They aren't pulling people over and searching for drugs as indicated in the case that you mentioned. This isn't the same type of checkpoint. It is a DUI checkpoint, different scenario.
@Oneness100: You are correct, if the checkpoint is only used for determining alcohol use.
However, your statement that "These DUI checkpoints are being done to check to see if you or anyone else is in violation of laws" describes an illegal checkpoint.
Same scenario. The court decision did not specify that it has to be a drug checkpoint to be illegal, just that is has to be a general crime detection checkpoint, like one that checks for violations of laws.
@Pafoofnik1 What i mean by illegal are registration, proof of insurance. I don't know exactly what procedure they are using once they pull you over, so i don't know if they are doing anything illegal or not. But if someone is drunk, then they have the ability to check for proof of insurance, registration, etc. Those are the violations i am referring to, not drug search and seizure. I am sure that if they smell marijuana when the driver rolls down their window, they can drug test, etc.
@Pafoofnik1 Well, driving under the influence of pot is a dui. If they smell pot when you are pulled over, they can arrest you and administer a drug tst. If it comes up positive, that's a dui.
@Oneness100: You are correct. However, what you are now describing is considered "plain view" probable cause. That's a far cry from generic checking of everyone to see if they are in violations of laws.
@Pafoofnik1 I know that is what i am describing, but all of the checkpoints i have ever experienced or that is a Sobreity checkpoint is looking for people driving under the influence and they will check other violations if the person is under the influence or they smell pot. The other checkpoints i've been at were border checkpoints and they only pulled people over if there were suspicious. For truck drivers, they have the weighing stations and i don't know what they do other than weighing.
@Pafoofnik1 That's what i have been tryng to say the whole time. The posting of illegal search and seizure only applies in certain, albiet, rare cases.
@Pafoofnik1 I guess. Apparantly, the case you brought up was a rare situation. Obviously, there are different types of checkpoints and they can do certain things depending on the type of checkpoint. But the sobriety checkpoints are set up to find driver's under the influence. Some pull every so many cars over and check out, some just do a quick 10 second questioning of every driver. I was in 1 DUi checkpoint and they just simply asked if you had been drinking.
@Pafoofnik1 the case you brought up wasn't applicable in this case where they are pulling people over at a DUI checkpoint, so the case you listed DOESN'T apply in this situation that this video is all about.
@Oneness100: Of course it's applicable to your assertion that "These DUI checkpoints are being done to check to see if you or anyone else is in violation of laws".
Here, let me quote the decision itself:
"Held: Because the checkpoint program's primary purpose is indistinguishable from the general interest in crime control, the checkpoints violate the Fourth Amendment."
@Oneness100: The case is applicable to your belief that "These DUI checkpoints are being done to check to see if you or anyone else is in violation of laws"
@Pafoofnik1 Copys aren't pulling people over with DUI checkpoints to revoked driver's licenses. They are doing it to deter driving under the influence, to catch anyone driving with any problems. For some stupid reason, some people seem to think that they are revoking driver's licenses on a whim. NO, they aren't doing that. They are just simply trying to deter driving under the influence, making sure people have cars and licenses properly registered, no outstanding warrants, etc.
@Oneness100: Driving a car is a right, not a privilege. We have the right to drive anywhere on private property without governmental permission. We as a nation have decided that a license proving proficiency is needed before driving on most public roads.

20 years ago I flew to Tegucigalpa, Honduras and then drove to Managua, Nicaragua. It was just after they had opened the border between the two countries after 11 years. Let me tell you about checkpoints - we were driving down the highway and came across about 10 soldiers that just decided to set up in the middle of the highway and stop whoever. Anyhow, they said they were looking out for us, and would appreciate a tip. Tip given.

shwartzenegger making money the easy way - does the CHP need a breathalizer for an impaired bust? i think all they have to do is think youve had a couple to be impaired - no blood test, no breathalizer
So what they got arrested. They SAVED a few hundred dollars by NOT hiring a limo. LOL. I've heard that the DUI is a few thousand dollars ticket, any idea anyone?
If you were heading south on the Silverado Trail and came to the Stop light on Trancas Road then turned right you would have been forced through the sobriety checkpoint. I googled "Napa Sobriety Checkpoint" when I got home and found out the checkpoint was running from 6:00pm - midnight. They had 4 people under arrest when I drove through at 8:30pm so I bet they picked up a lot of DUI's Saturday evening. I talked to a couple of other drivers that told me Dry Creek set one up a while back.
I did a U-Turn about a Kilometer or so before a checkpoint once as I saw a good gas price while driving by (It was late at night as well) a cop chased me alllll the way down from I don't even know where and tried to question me while I was filling up on gas.
