They have no right to question you, or to ask you to pull over, or to identify yourself, and they KNOW IT. There are many Border Patrol stations far inland hundreds of miles away from the border that strictly work interior enforcement. If the constitution were in force, they could not check citizenship even at the borders. The constitution provides for commercial regulation in the enumerated powers, not citizenship checks. Perhaps entry is a state right (once exercised by california to violate the rights of ethnic chinese), but, given the UN rules, the right of border passing may be universal in America.

I think people are missing the point of this.. these checkpoints have NO authority and are unconstitutional. They have no right to question you, or to ask you to pull over, or to identify yourself, and they KNOW IT. Thats why when the "agents" are asked "where are YOU comin from?" and "do you have ID?" from the driver, they let you go, because they know their checkpoints are bullshit and have no authority.

@burtontoker Under Sections 235 and 287 of the Immigration and Nationality Act, Border Patrol Agents are empowered to stop and question a person concerning his/her right to be or remain in the United States if the Agent believes that the person is either illegally in the United States. When people act like dumbasses at these checkpoints, these Agents know that they are dealing with another "contempt of cop" scenario so they send you on your way because they just don't want to deal with it.

The INA also gives Border Patrol Agents broader arrest authority to make arrests for ANY felony cognizable under the laws of the United States. No where does it state that their is a geographical boundary to this authority other than within the continental U.S. and it territories

Bottom line is that he didn't play their game, so they smashed his windows and tased and beat him. He ended up willing his criminal case. The border patrol had no legal grounds to do what they did. There are many Border Patrol stations far inland hundreds of miles away from the border that strictly work interior enforcement. Just to name a few in Texas...Lubbock, Midland, and the Abilene stations.

Most of my family works in law enforcement, tucson az area. The reason why they treaded you like they did has many reasons. ALOT of mexicans (cartels)recording border crossings, to record what law enforcement does.. I'm sure the officer didnt think you were illegal, however you fu*ked with them... They fu*ked with you. As far as i know, individual states and militia's do this. Better then these check points do..and much more kindly. surprisingly.
