The answer is both Yes and NO. I am a cardholder so it is perfectly legal for me because it is a medicine. The laws have been dead since 2001 but they refuse to take the law off the books and fix it properly by taking it to the house as a whole. So the answer is yes it is legal, but you will still be busted, however EVERY person charged in that time can get the charges reversed and all your court fees given back and you could then turn around and sue the government for falsely imprisoning you.

Anything less than an ounce is usually just taken from you without penalty. It isn't worth their time arresting many users in Vancouver. I know they do but, compared to most places, Vancouver cops usually just don't care.
Hell, my friends & I were smoking a joint out front of a bar. A cop walked up behind me. I was like, "how's it going?" & he just smiled, talked for a while & told me to have a good night. Didn't care that we were getting stoned while holding a 1/4 ounce. Not worth their time.

In Canada if you get caught with anything more then a half-ounce, you might be charged with trafficking (if its with a scale/in baggies). Marijuana is NOT legal you can be charged or even put in jail if you are carrying or consuming pot.
however under special permits is legal to grow and harvest Marijuwana, most of these permits are obtained through medical treatment tests.
Marijuana laws are very loose and most often not enforced in many parts of the country, but don't test this theory with a illegal grow op or very large amounts of the drug you will spend time in jail, sentences rarely exceed 5 years.

no it's not legal but there not as harsh about it in canada as in the u.s, if you get caught with a couple grams it all depends on the cop, they can arrest you but you would get a fine or 60 days in jail, something to that extent, they manily focus on large trafficing and grow ops.

It never was and never has been LEGAL in Canada. It's been decriminalized provided you have less than 15 grams. If you have more, then you could get a fine or charged with trafficking. Most of the time when you're caught with weed, the police will just take it away and then go smoke it themselves. hahaha. However, if you're driving while smoking or are clearly high. The police officer can use his or her own judgement whether to slap you with an impaired driving charge and suspend you licence.

Anything less than an ounce is usually just taken from you without penalty. It isn't worth their time arresting many users in Vancouver. I know they do but, compared to most places, Vancouver cops usually just don't care.
Hell, my friends & I were smoking a joint out front of a bar. A cop walked up behind me. I was like, "how's it going?" & he just smiled, talked for a while & told me to have a good night. Didn't care that we were getting stoned while holding a 1/4 ounce. Not worth their time.

@JakeSuma It's April 20th (4/20 Day) and Cannabis Day (July 1st or Canada Day) for Vancouver. Those are the days where you go into the center of the city and have a huge smoke out where people openly sell marijuana and give it away for free in vendors. Great thing to check out. :)

It is illegal in Canada according to the Criminal Code of Canada. Although, under Common Law, it is not (whereas, no reasonable cause of harm or violation). Most peace officers are cool with it, but the rookies are looking for a promotion (not all rookies).
I have found that city cops will harass when given into. That is only if you can not speak legalese.

@break101- I live just outside toronto and have been caught like 10 times with marijuana, normally the cops take it from you and just send you home with a tap on the rist, i have never been arrested or charged, One crazy instance was when me and a buddy were sitting in an alleyway rolling a joint, and a cop car pulls up, the cop ctually pulls the joint from my freinds pocket, then gives us a 10 minute lecture about marijuana being bad. At the end the cop gave back the joint. I love CANADA

In Canada if you get caught with anything more then a half-ounce, you might be charged with trafficking (if its with a scale/in baggies). Anything under that all we do is take it away, some might not even do that. Cops deal with murders and convicts all day, the least of their concerns are a few guys smoking some dope.

You can be busted for pot if they feel like it, ( if you're being a drunk / dick), but most cops are cool and if you're being responsible usually they won't bother.
However our cultivation laws are going retro here as of late they're changing the penalty for cultivation of 3-5 plants, upping it to 6months jail time to try and keep pace with the other fascist draconian measures the reptiles are implementing world wide. less than 5 grams is a straight ticket if anything, odds are they will just take it for themselves and give you a warning. you only really get in trouble if you have more than that or a scale, some bags, something that would show your dealing somehow. still if that comes up and you get caught, its usually only a couple days inside. it is still illegal but its closer to being decriminalized in small amounts

Marijuana is NOT legal you can be charged or even put in jail if you are carrying or consuming pot.
however under special permits is legal to grow and harvest Marijuwana, most of these permits are obtained through medical treatment tests.
Marijuana laws are very loose and most often not enforced in many parts of the country, but don't test this theory with a illegal grow op or very large amounts of the drug you will spend time in jail, sentences rarely exceed 5 years.
