We was all told the reason he cant fly in the first episode of season 9 "Savior"

Its is because he still thinks of himself as human and not kryptonian, jor-el said he need to cut all of his ties will humanity and because he was falling for Lois at the time he never did that and couldn't, that why he cant fly yet

I read that the producers of the show changed. It was the old producers that made up the rule about flying. He may actually fly in the episode. The new crew may have thrown out "no flights no tights" policy they have. Also they have a suit ready for him to wear whenever they decide to write it in. The styling is along the lines of the green arrow's costume.
