  • @MrHuds88 PC is not well defined, and never has been. Has always been a vague, gray area. Must be more than a hunch or suspicion, and supported by the events that have occurred. eg: cops respond to a fight, someone reports a gun involved. They arrive, someone points to you and says "he pointed a gun at me!" They have PC to frisk you. Other than following legal precident, there is no definition.

  • A Highway patrolman pulled me over for no lights (6pm in Sept). After 30 min. running my id he issued me a citation light not bright enough on my plate.

    I got out to check the light (I was pulled 10 ft off the road) he got out of his car and pulled his gun.

    At trial ( I sued in civil court) he said he was just worried I would get hit in traffic.

    after 1 hour case and 1 hour of jury deliberation, I was awarded the full judgement. The ex-officer is under indictment for excessive force.

  • This flex your rights shit is dumb, just let the cop do his job and you will be fine. Most of the time the people taking these tips are people that are breaking the law in the first place. If you have nothing in your car let them search it, if he have nothing on you let them pat you down and search your pockets.

    Then you can be on your way home or on to doing what ever you were going to do. Throwing this legal bs out at the cops will just make things worse for you.

  • Please be aware that as a law enforcement officer who's been through law classes and courts, these videos are pretty good, but this guy does *NOT* give you all of the details. There are caveats and special circumstances under which frisks could be justified even if they cannot show reasonable suspicion that you have a weapon.

    Do a little investigating. 17 is legal in a lot of states. 18 is the technical number, but one year younger is legally acceptable in many places.

    Before, I believe. It's always best to tell a officer if you have any kind of weapons on you or in your car as soon as you begin talking to one who has pulled you over or stopped you on the street.

    I almost always am armed when I am traveling in my state. I have been stopped on occasion, most always for speeding. If the officer asks me to produce anything (license registration), I keep my hands on the steering wheel, inform him that I am armed, where the weapon is, and ask how they would like me to proceed.

    It has never been a problem.

    Internal Border Patrol checkpoints? I don't think they need to know.

  • I have called them out to my property multiple times for the neighbor beating his girlfriend and i am the one who always gets frisked. i never give them permission they never ask, they just do it. our rights and how police practice are two completely different things. and be careful exercising your rights. if you piss off the police they will make up a reason to arrest you.

    i called the cops after being assaulted by a bounce on a public sidewalk and he admitted it but i went to jail somehow.

    "the police officer has a reasonable suspicion that the person has committed, is committing, or is about to commit a crime and has a reasonable belief that the person "may be armed and presently dangerous."

    THEY MUST HAVE PROBABLE CAUSE. JUST LIKE WITH ANY OTHER SEARCH.

    The Fourth Amendment is clear. There's no loopholes, no exceptions to exploit. It protects citizens from abuse of power.

    BTW, the quote you made states "reasonable suspicion" which is DIFFERENT than "probable cause", which you cited in caps. They do NOT need "probable cause", as you claim.

    Police are authorized to perform such frisks when, given the totality of the circumstances, the officer has reasonable suspiciion the person MAY have a weapon. Criminals often carry weapons

    That brings me back to my original point. With no criminal record and no other suspicions, the police had no legal basis for frisking me when I reported my neighbor for beating up his girlfriend (twice.)

All I ever claimed is that the police DO NOT have the right to frisk anyone anytime they feel like it, even if it makes them feel safer. The Terry law is very clear in this manner too, and what I said isn't opposite at all. The 4th Amendment is clear. The Terry Law is not a workaround, there still must be suspicion of wrongdoing in order to frisk.

I saw a cop car and waved at them, and they drove over to me and started questioning me about what I was doing. I told them I was walking home and asked if they would mind if I got a ride to my apartment, and they drove me there. The cops aren't as bad as you think.

  • Frisking someone is searching for weapons it doesn't really matter what they were doing before you confronted that person or persons involved. It is simply to make sure you don't weapons on you that could cause harm to them or others. If they know your'e not armed they will be at ease.

    If you did not consent to the search and there was no reasonable suspicion that you were armed or probable cause to search you, then any evidence that was found during the search probably falls under the exclusionary rule. That said, being in a certain place at a certain time can be probable cause.
