  • Well, I hope you get sued. The guy never left the store as shown in the video. All I saw was an assault take place and one LP getting fired for false arrest and too much force. You can see he had the intent to leave the store but he did not. I am and LP investigator and I have had plenty of people take shit . walk to the door and drop it and NEVER leave the store. Bad call on your part, a judge could easily say he never left the store.

He almost didn't become rich, because he wanted to be a minister. But instead he went into business and began buying mortgages. 80% of all millionaires are first generation. Like I said though, that really doesn't matter because it's every bit as bad to steal from a rich person as it is from a poor person.

  • Well I have to be honest this is my 10th year working in loss prevention catching shoplifters. I don't know what your company's detention methods are but I have to say takeling the suspect when they haven't displayed violence or attempted to flee is probably not the best thing. Yes I firmly understand that each situation is different however I don't see cause for those actions. Too often young/new LP's don't receive the correct training and overeact. LP's that have been trained don't do this.

  • @fishrcoolturtles2 Believe it or not, no. In most states the law is upon concealment is considered theft. In this case the suspect did exit the store and here is why: once the suspect places the merchandise between or past the alarm then it is theft. The arrest was lawful BUT the detention method was excessive.

    why a simple push is an assault? shoplifter could have a knife; moderate force is needed sometimes and this is an example of moderate force

Back to your post, technically the suspect did cross the threshold of the exit by pushing the cart with unpaid merchandise in it entering the EAS system so there was a theft. I think you meant nobody asked for the receipt (not "receive"). You are correct in that it's not necessary to ask for one. It appears to be a felony amount of theft so I understand using caution but seriously? THAT WAS EXCESSIVE!!!

  • @13haunter I hope you can understand now, the law is if ""YOU KEEP OUT THE STORE DOOR MERCHANDISE WITH OUT PAID"" and yes is excessive!!, and yes he have to ask for RECEIPT ( thanks), because the suspect didnt hind in pocket or bag pack, even he dont try to roan, you can hold the hands but not hit or bring down, is unsafe for all, the suspect , for you and a other customer .( and I continue learn spell and speak English thank for you understanding).

  • @13haunter If you steal food you'll have to do it everyday. If you steal something worth money you can use the money to better your self. Don't get me wrong i'm not for stealing, just sometimes rent-a-cops take it too far. These people arnt committing a violent crime. The only victim is a billion dollar corporation that's barely even pays its employees. Good to hear you think he should be fired though. You guys arnt all like that.   • I've been doing loss prevention for over 22 years, and while I think the guy was definitely going to steal, I don't see a single thing the LP did right here. Too much force, stop was too soon. Lawsuit waiting to happen.

  • For those of us who don't know: Which laws applied in this case (and which state did this take place)?

    Specifically:

    1) At what point did his actions meet the legal requirement for being shoplifting? (ie, the point at which he would fail at claiming he was not stealing) A lay person might think since he never actually left the store, he might have a defense.

    2) What law allowed for the use of force in this case? ie. Would you be protected if he sued you for unreasonable force?

  • @MoilAndToil So many differances in laws between states. In my state we must have visual contact of the shoplifter at all times. We must see them take it off the shelf, coneceal it, keep eyes on them the entire time, and see them pass the point of sale.

  • @1982mitzy intent makes it shoplifting. And yes, because he is past the registers -attempting to exit. If there are tv's outside your wal-mart and you touch them, you're obviously not stealing. BUT if you grab one and throw it inside your cart without regard for price or product details and then make for the exit... and then you get apprehended and admit that you were stealing... then it's shoplifting.

It was a probation violation on top of the larceny theft so he did time. Short time -but still time. And yes, he did pass all points of sale so all elements were observed. You have to remember that company policy can be interpreted different ways but its the law that matters.

  • FAIL. target asset protection policy and most municipal laws state that the person must be outside of the store, before u can apprehend him/her. and does target know u are posting their videos on you tube (probably not)

  • @kansas66204 That is not entirely true. Depending on the state you are located in, once they pass the registers hence ALL POINTS OF SALE, they may be subject to arrest. They Target store I worked in (NYC), once you passed the registers, you were only a few feet from exiting. There weren't any vestibules at that location.

  • @kansas66204 Actually that isn't Target's policy at all and also, most municipal laws state all the person has to do is show intent. This means they don't even need to be at the front of the store or even close to outside. You should really check your facts before you post. FAIL

It's after the last point-of-sale that you are allowed to detain them (not apprehend, that is a synonymous word for arrest and AP cannot legally do that). You are right though, he is not allowed to be posting this video since it is propietery property of Target. And why is he calling himself a "detective"? They were called Assests Protection Specialists and Target Protection Specialists. I used to be a TPS myself.
