  • I have been a worker with a 46 year career. I have been in units faced with the choice to organize or not several times. A secret ballot is a better measure of the workers' intent than card-check, which is unsupervised and subject to serious potential for bullying.

    Let people choose by secret ballot free of muscle.

    Why not tell the truth?

    I have repeatedly gotten material from SEIU which is misleading and underhanded in its presentation; not what I want in an organization representing me!

  • I see. I'm still skeptical though. If the unions really weren't biased with this issue and only were concerned with the time factor, they would find a way to be fair, have secret ballots, and still have workplace democracy. It seems like they are allowing a temporary inconvenience to be an excuse to get the policy they want. Aren't unions used to dealing with inconveniences?

    I have been on both sides of the spectrum. I was an hourly employee, then mngmt at the same job. I have seen both sides.

  • well let's think about this...if 50.1% of the employees in a workplace sign cards saying they want to form a union...isn't that the voice of a majority vote? the free choice comes in saying that if employees aren't comfortable signing cards, they can ask for a secret ballot vote, and if demanded by a majority, ie. 50.1%, that is what they get. a secret ballot vote. as for the non-union minority, should the union pass, i also would hate to be forced to have better health care and wages. boo hoo.

  • Maybe this guy does not even know or understand the law he is advocating, but the legislation, as proposed, would not allow a secret ballot election if there are cards signed by 50% +1 of the employee group. It is not a matter of choice. The law would not allow an election in this situation. That does not sound like free choice to me.

  • Why is there a need for two elections? If you get 50% + 1 of the card signup, that's a decision.

  • Yes, it is a decision, but it is not made in the privacy of a voting booth where neither the union or the employer can assert any undue influence on the person casting the vote. The EFCA would take that right away from those employees who do not even know that card signing is occurring. Section 7 of the NLRA protects the rights of the employees to form or not to form a union. Card check would potentially deny those protected rights to some employees.

  • This idea that all votes are supposed to be private is an idea invented by the rich economic interests trying to defeat this fair bill. One vote is all that's needed.  A second vote only gives the company a chance to play vicious games for defeating the employees' choice. That must be stopped.

  • Exactly whose rights is this bill trying to protect, the union's or the employee's. The only party afforded rights under Section 7 are the employees. To ensure that their true voice is heard, I think a secret ballot election is required. This video is just one example of the misinformation campaign that is being pursued by the supporters of this bill.

  • No, all they need to do is make their first choice. Why should people have to vote a second time? It's simple and fair. And nobody makes anyone make the choice the first time. So why protect companies from their own bad management and poor treatment of workers? Why do they need to be coddled?

  • Recent study showed that 2/3 of companies broke NLRB rules when faced with organizing. Who has the power to intimidate - the Union that does not yet exist (the one being voted on) or the employer who has the ability to fire the employee? Please wake up.

  • The EFCA will introduce tyranny of the majority into workplace. If just 50.01% of workers want a union with card check, it's in! And the other 49.99% just have to deal with it.

    Btw, when they do form a union under EFCA, will workers who didn't want the union be FORCED to join if it a majority says so?? Or would they still have a choice?

  • Why are new unions so unable to form? Maybe it's b/c they're just not powerful enough, and workers, for the most part, don't give a shit anymore? Unions used to be much easier to form, but they're too weak, so they want gov't protectionism.

    How exactly does this NOT eliminate the right to a secret ballot? The guy in the video didn't explain that fully.
