For the specific problem of ilum i'd say put a limit to the number of player for each faction. From a technical point of view yet it may mean instance the planet and that could require a too big change.
But this game is old in so many ways i'd just let it die... A new game with nothing really new SHOULD die.
at least there's active PVP in The Old Republic. i play City of Heroes and the PVP Zones and the Arenas are all pretty much dead... people including myself actually played PVP when it was first brought into CoH but when they started nerfing powers people, including myself, lost interest.

If they added a 3rd faction the problem would then change. This would create a flux that would force the stronger faction to face down 2 weaker factions at once making it less likely for them to win. Or of they are all balanced then it could be rather interesting. From what I've seen in the story there are force users that don't choose the republic or empire. Plus given a player the choice to defect to one or the other side would also give them more options.
@DemonOfMyMind They really need to stop doing MMOs with two factions. It just has so many inherent problems. Three factions could work well, but I truly think one faction MMOs are the way to go. GW2!
@bogotter Its a little late for TOR to try and merge the factions. I agree with you that one faction is the way to go. However, since the factions are already in TOR, adding a third faction and the option to leave your faction to join another would provide a new balance to the game that could help to save the game a bit of trouble in the long run.
There was no chance of TOR having faction balancing on the servers. When you give the Empire a class with an ability to shoot lightning at everyone and not give something equivalent to the Republic every single person is going to be playing the guy who can murder everyone within the range of his lightning. The only way I can see Bioware fixing this is implementing a sort of limit where the population balance cannot exceed say 1.5:1 or to set fixed limits for characters from both sides.
