  • I have to say that this police officer should be fired... If you look at 7:34, he does not resist, than at 7:37 he goes down and Adam still not resit. And at 7:44, full body slam and chock him when the only thing he had to do was to bring these arm behind and put the hand cuff. Plus, at 7:53, he seem to go for some sort of submission just to stop it before adding a few injuries- this cop is incompetent in grappling and act dangerously. He is not even good enough to be a security guard.

He was not using strenuous and/or violent force to resist arrest, it just happen that he did not put his hand behind, he just proceed with difficulty. At the maximum, this fall in some sort of gray zone with reasonable doubt on both side, and in case of reasonable doubt the police should lose because they fail to bring a burden of proof that it was required. At the minimum is... What were the cop thinking!?!

  • @therrydicule You obviously have a warped definition of the word "resist." Resisting does not mean to actively fighting back, but literally just to resist the police from arresting you. Adam WAS resisting. He refused to be hand-cuffed by resisting to put his arms behind his back. He was over-powering the police officer. Keep in mind that Adam is a very buffed person, and he is a trained U.S. soldier that was in the Middle East. Officer tried to bring his arms back, MULTIPLE TIMES.

Particularly: identification, because he got music in is fucking ear (earphone) the prerequisite of clear instruction from the police officer is missing. And the fact that he does not seem to be really strenuous...

    So, I will say that the police used brute force a bit too fast.

    Not to say that the cops had any reason to arrest anyone; but resisting arrest is not being compliant. Not turning around when told, give them your hands, not laying down with told. He by his body language was resisting. I would sue the pants off them for arresting for people for dancing.

However, in this case, because it's a misdemeanor, that Adam was listening music on earphone : any procurer that try to bring that in court will finish to look like a tool... Just question of being reasonable & procedure. To accuse someone of resisting arrest, one have to show that this person intended to resist the arrest. Was is answer an automatic answer to an aggression? Did he ear them? Etc.

    You can't won that case.

But him not rolling over, giving him his arm is considered resistance. They will charge you with it even if you are being non-violent.

One of my friends was at a bar and she started to dance (not out of hand, just shaking her hips a little) and the bouncer told her to stop because the bar did not have a dance license. She kept dancing and they kicked her out. Funny shit.

  • I agree that this was excessive use of force and holding a protest or just dancing at a memorial shouldn't be against the law. But Adam wouldn't put his arms behind his back as he stiffened his arms that's why that happened. Unlike the code pink girl who did put her arms behind her back. And people should understand there are ways to go about having government redress your grievances. Acting like a kid or a European is not one of them. Be intelligent and proactive write your congressmen first.
