  • Louisiana you can get away with many infractions except speeding. I will not buy a car without cruise control I use it even at 35 to keep from getting a ticket. Speeding you really don't get there faster all you are doing is burning more fuel and eating up your brakes. Speeding is not wise if you speed you are preventing other traffic from making turns or getting on the road you are not being curtious. If the rest are going a bit quicker go with the flow but if you can do the speed limit.

  • I once got pulled over for 45 in a 30. When the officer asked me how fast I was going I told him 45 mph. He told me that I was the first person to tell him the truth in over a month and let me off with a warning. Don't lie to the officer, it just makes them more likely to ticket you.

  • I have a great idea! If you make a mistake and get caught, how about just "man up" and accept your fault!? I know its a hard concept to handle, but it should have been instilled in you when you were growing up.

  • When you are 'detained' by an cop you are under arrest. Any time any cop gives you a ticket you are under arrest. The say your are being 'detained' because if they told the truth they would need a warrant to stop you, so they lie. Go to court by all means (my opinion; I am not an attorney.) To be convicted of a crime per the US Constitution there must be a victim, corpus delecti, or there is no grounds for the prosecutor, no standing for the court. Honest judge: "CASE DISMISMISSED".

  • But THE BEST WAY to get out of a ticket is to be honest. If the officer asks if you know why youre getting stopped, and you do. Just admit it. Example; "ya officer as soon as i saw you i noticed i was going a bit too fast. Im sorry my mind was elsewhere and not completely on my driving as it should have been. I'm a dummy". I'm WAAAY more likely to let that person go then the one that says,"I have no idea", when i know, we both know why i stopped them.

  • @shmoopify Never admit anything to a COP! Change the subject such as: "Why did you stop me." "I'm sorry I don't understand why you stopped me. Am I under arrest. I made a running stop, really? I always drive safely to my best ability officer. Officer did I injure anyone? Just don't agree with him. He's trying to get you to contract with him; don't do it! When he gives you the ticket be polite always and then sign the ticket and go to court. Remember, no victim, not crime. My opinion.

  • @xmenrus - I'm sorry. Maybe you missed the fact where I said I am an officer and currently a motor (traffic) cop at that. I'm just trying to help you folks. Please dont write info on here that is TOTALLY wrong! We don't need a warrant to stop you when a violation has been committed (thats ridiculous). Also, when an officer sees you commit a violation and you say "i dont know what i did", he knows youre b.s.ing him and that just makes it easier to write the ticket. Harder to cite nice people

  • @xmenrus -Another thing.As far as "corpus delecti" (no victim) goes.When you get your license in ANY state you agree to follow the vehicle codes. When you violate a vehicle code,the victim is automatically the state in which you made the violation. Example; if you get a speeding ticket here in California, when you go to court, the victim is The State of California. xmenrus, please dont spread bad info when you have no real knowledge of how the system works. Youre going to get people in trouble

  • I'm a motor (traffic) cop in Cali. A few things he said were true. #1. If you plan on fighting the ticket, dont do ANYTHING during the stop that will make you stand out in the officers memory. Be polite, and just sign the ticket. #2. we do take notes, and if you say anything that admits guilt we might write it down. HOWEVER, i firmly believe if you got caught doing wrong, and you know youre guilty, just "take your medicine". WHy fight it? I think that's dishonest.

  • @shmoopify All I say is only my opinion and I am not giving legal advise. I do read the judgements of higher courts who over turn DMV judges when challenged on the 'corpus delecti' issue. Judges take and oath to support and defend the US Constituion and when the constutions defines "valid cause of action" required to accuse any citizen with a crime the courts have to support and defend this. I've spoken attornies on these issues and they either speack frankly or they 'tap dance'.

  • @shmoopify And yes, I am always very polite with cops. They do a nasty job, such as east LA, and their lifes are endangered all the time on duty. This is documented by the facts. But, NO. how can you contract with someone who is accusing you of a crime when there is no crime per the constituttion. NO, the state corporation of California can't be a victim. It is a legal fiction. I've confirmed this. Again this is my research and mine only. If you want legal advice see an attorney.

  • @xmenrus - well your research is wrong. Any state can be a victim. When (as an officer) I am charging an individual for a crime such as 148pc for example (resist obstruct or delay an officer in the course of his/her duties) it is not me the officer who is the victim, but the state. Yes the Constitution is the base for all rights, however in order for laws to pass they must also pass with the courts as being constitutional. One of them being the state can be a victim when certain laws r broken

  • "I believe it is 65 mph" is the wrong answer. You admitted you knew that the speed limit was 65 and you were going over. they will use this in court.

    Not being aware of the speedlimit is even worse in my opinion and you shouldn't even be on the road if you dont know what speeds you should be doing on certain roads, especially if the roads (which they usually are) are marked and signposted with the speedlimit. Not paying attention, eh?

  • Sign it with "Per:" In front of your signature! You are acting as agent for the legal fiction account which bears your name! When you sign your name here like this guy does you are entering Joinder, which means you are becoming a party to the contract that the officer is presenting you with, and then you will have to plea with the judge. You can also write, "Without prejudice" or "under duress" under your signature to prove that you were intimidated into appearing before the court.

    p.p.s. in California officers are required to approach the passenger window, so try pulling over on the left shoulder of the freeway, and they may not approach you car cause of the traffic...just spit ballin!!

    In my experience they always come to the drver's side first and then the passenger side after they've spent twenty minutes pretending to do stuff on the laptop in police cruiser (they're actually playing video games).
