Well. In prostitution, the tests happen AFTER the act has occurred. The health issue is the customer, who may or may not be HIV positive. Because of the issue of the customer's own health, prostitution can't be made legal.

Prostitution should be legalized for sure. The way they have it legalized in Nevada should be how they regulate it everywhere in the US and other countries

But massage parlors already are legal! All you do is tip massage therapist according to what you want. As long as either of you don't mention the buying or selling of sex, it's legal, because if sex happens you can still argue it was the result of an irresistible spontaneous attraction. licensed brothels have been legal here in Victoria, Australia since 1984. Regulation prevents violence, corruption and disease.

Attempts to legislate morality by prohibition are always counter productive. If any doubt exists a brief survey of the history of such attempts, and there are many, would dispel any such notion. What is beneficial is to allow said activity and regulate it in order address any legitimate concerns the public may have. This applies not only to prostitution but also the use of drugs, including alcohol and tobacco, gambling, practicing law, holding public office, practicing televangelism, et al.

Politicians just make prostitution illegal to many all their voters believe "they have moral backbone" when they are same people who are soliciting prostitutes in back alleys and meeting men in bathrooms for sex.

Many high-ranking politicians - including those who are supposedly enforcing prostitution laws - are the very people hiring prostitutes. I think it was the governor of New York who was caught last year hiring prostitutes and he ran on a campaign of cracking down on prostitution.
