Yes, there probably is illegally distributed copywrited material on mega upload, there is also legally distributed content as well, files that people have put up so that other people can download and enjoy their created content .
@TheHerbulator I have no problem with the Internet. I think it's great. I love being able to download music THAT I BUY, watch movies THAT I PAY FOR, play video games online THAT I SUBSCRIBE TO. These are great innovations. Theft, however, should not be tolerated.
@mwhitten77 And this is when we end this, because you're ridiculously set in your ways. I love seeing that same argument style for anything, its when you know that you're wasting your time.
@nihilistsneedhugstoo Bullshit. It's a file-sharing program. You're simply wrong about that. Copyright violation is theft of intellectual property. It's not robbery, like if you steal my bike, or shoplifting, if you steal from a store, but it's still theft. Read a law book, fuck off.
@markspence20xx I can't tell if you're being facetious, but here's the problem broken down: a musician releases an album, it's uploaded to Megauploads, then EVERY time it's downloaded represents a lossed sale. This actually hurts the smaller, independent labels more than it hurts the big ones, so music would really start sucking. Why would you want programs like Megauploads to continue?
@mwhitten77 On top of what the guy who first responded to you; the internet isn't just a side thing to business, it has literally demolished the old business model, and that's what capitalism is, for businesses at least, if you don't adapt, you're probably going to fail. The innovation that the internet offers is MUCH more valuable, than what the standard business model offers.
In America there hasn't been due process in 9 years. When will you stop expecting it to be there and fight for it as a concept outside the specifics of each individual case. There is no due process for Private manning, julian assange, any brown person of choice, and now any american citizen affiliated with a brown person of choice.
@markspence20xx That's not what he meant or said. He's saying that black people, and other non-white minorities, are discriminated against by law enforcement, courts, etc. It's not a 100% thing, but its there, that being said, its also extremely over exaggerated.
@markspence20xx You don't understand english and shouldn't attempt to correct others. It could mean one has chosen to be brown or it could be a brown person who has been chosen. You're infantile mind just picked the wrong one.
@Taiolu Oh, so it's the job of the copyright holders to police Megaupload to find people stealing their material. Sorry, bro, that shit doesn't fly. Plus, the way the system is set up, EVERYONE on Megaupload is a fucking bot: you upload something once, and all 50 million users can download it. How can you defend this shit like they did nothing wrong.
@Badchoicesmade I've heard that argument before too. The problem is that Megaupload takes no action to ensure that people aren't using it to break the law. If you're an artist and you want to share your music for free, make your own web-page, or create a Facebook page. But the fact that some people may use it for that purpose doesn't negate the fact that so many more are using it to break the law.
@mwhitten77 They took action though, they gave copyright holders the ability to take down infringing material. They didn't however unlike youtube give them the ability to run bots.
@lambofreak55 They aren't websites, they're programs, and whether it's a by-product or not, it's still illegal. People who use the program in the manner in which it is intended can more easily break copyright laws. If it was only intended to put your file somewhere without having to transfer it, then why are other people allowed to access it?
I honestly don't think that TYT understand how these file-sharing programs work. If they did, they wouldn't be defending Megaupload. This matter has nothing to do with the freedom of the Internet; it's about programs that by their own design make it easier for people to violate copyright laws and do nothing to try to stop their programs from being used as such.
@mwhitten77 Thats not exactly correct. These websites are not specifically designed to allow people to be able to distribute copyrighted material, its just an unfortunate by product. What the website is, is they say "here you can put your file here without having to transfer it manually, and without anybody invading your privacy and checking everything you are sending" it is literally like an online post office.
@mwhitten77 It's true that Megaupload does have copyrighted material, but it also has a decent amount of artists trying to get their content out. I've seen a lot of artists using sites like megaupload and soundcloud to upload their music so they can give it to their fans for free.
@carboy101 Dotcom tried to keep it overseas too, he just screwed up and had a few servers here in the U.S., and that's what was used to take him down.
@Neojhun Why would anyone use a file-sharing program to "store" things? Even the 10% that you talk about (and I actually think that's a little high) arent using file-sharing programs for "storage."
@PointyGorman Um, yeah, you're retarded. Google and YouTube aren't providing a program where others can DOWNLOAD copyrighted material. It's the ability to download that makes Megaupload different.
They should go after Google, their search engine can be used to find torrents (same as Torrentz) and youtube can be used to upload copywrited material (same as MegaUpload). Durr US Gov't. Honestly anyone hosting anything in USA is just asking for trouble.
@Twestination Not where? Where do you claim to live that copyright law is so different? And how is it illegal to "share" but not illegal to download it without paying for it?
@amfanmagician What are you talking about? Where are you getting your information from that there was lack of due process, pulling it from your ass. Why would anyone, other than the users that were using the program to steal, lose any of their files? They had them on their computer; the government isn't erasing stuff off people's computers, they seized Megauploads data from their servers.
been watching TYT for years and I must say the 'floating' camera style is fucking annoying. If I wanted to watch CNN with all their flashy bullshit, I would. Just leave the cameras on a tripod and report the news.
Out of curiosity, how many people used MegaUpload to store say, important documents like school/college/university work? Looks like they're going to fail their courses thanks to the Government.
@Neotails8762 Unfortunately, you don't know what you're talking about. You don't "store" things via MegaUpload, you "share" them, so anything documents that somebody is sharing on MegaUpload is already on their computer's hard drive. All that MegaUpload does is allow them to share it from their hard drive.
@ttzz2003 If there's evidence on those computers, DotCom's attorney can file a motion asking a judge to issue a stop order preventing the deletion of the files.
wait wait wait Anna has good point but woouldnt this disapperence of evidence play in intereset of megaupload.. assuming that presunce of innoncent of still in palce in U.S.
If the data gets deleted and Mega cannot use it as evidence to defend, so does the prosecutors.
I thought the court only have to prove the accused guilty, not the accused to prove themselves innocent. Unless the court has access to that stored data but Mega does not.
What happens to the customers who paid for a year or years in advance of service as a bulk prepay? You save a lot of money doing that. Are they going to get their money back for the unused months that won't exist if the company doesn't exist anymore? What if you just signed up for a year of service a month ago, it got shut down, and you don't get to have service for the remaining 11 months but you already paid for it.
@395235 I'm guessing 90% of them are not using megupload for legal reasons, mainly obtaining pirate copies of media. For the 10% who use it for storage i'm sorry you should sue the US Gvmt. But for the 90% they had it coming.
@395235 Nobody seems to remember that this exact thing happened over a year ago to all the top online poker sites. This isn't a new thing that just started. I believe eventually the government gave players their money back, so I'd assume the same will happen here.
@TheLordDai thepiratebay is a Swedish site :p and since Sweden is not a state in the US, they have no obligation to do what the US government wants them to because US law does not apply there
@Gopsaholic but the whole megaupload company is based in hong kong.. and most owners live in new zealand only 2% of their servers are in US and the rest all over the word.. and US law doesnt apply there either.. megaupload is a hong kong site.... also have you noticed a LOT MORE illegal pirated stuff on lots other sites now megaupload down?? 2012 isnt the end of the world.. its the end of the internet! lol
@TheLordDai They go after Piratebay every other week. But they legally can't do anything. TPB has literally told them they can go f*ck themselves with a bat.
@TheLordDai Some internet companies here in holland had to block thepiratebay because of some retarded judge, Luckily there's a big chance they win in the higher court.
Downloading copyrighted material for personal use is legal anyway.
@Twestination What other use is there, other than "personal use?" You are simply wrong. If you download a song to listen to it, and you haven't paid for that song, it's illegal. If you download a movie to watch, and you haven't paid for that movie, it's illegal. If you download a book and don't pay for it, it's illegal. The only time I know of that somebody can reproduce copyrighted material are professors, who can make photocopies for academic use for their classroom.
@markspence20xx yes but its kinda strange, because the EU says its illegal. I guess its the same in the states where state law allows something that federal law prohibits.
@TheLordDai Piratebay is just providing links. It's not storing any files. So by going after Pirate Bay the shared files would still be out there and alternative torrent websites, whoch basically do the same already exist.
@Th3Vik1ng Yep, that's why thePirateBay is basically untouchable now, especially after changing their domain name to a non-American domain. They will always be a step ahead of the buffoons in the media industry and the government. The only solution is for the media conglomerates to change their antiquated business models before it is too late, they need to see that the writing is on the wall.
@TheLordDai They can't because Pirate Bay is in Sweden. The Swedish government went after Pirate Bay a few years ago, but Pirate Bay ended up winning.
@TheLordDai There is too much heat on "pirate bay" to the point it is well known name in the non tech public. Megaupload is a realatively unknown name with some very very shady tactics. Feds were just picking low hanging fruit. It has set a scary precedence, this is the first time i have ever seen major effect on the internet by Gvmt action. Their first and negative one .
@TheLordDai If they wen't after The Pirate Bay, people like my father and his business cohorts rather than me and my construction crew would be agitated. I think they wen't after megaupload because it's important to those who are relatively versed in new technologies yet unimportant to most. Essentially if they shut down the pirate bay they would turn politically inactive people into active people which i think they fear.
@StoneTNo5 its only considered bad because a lot of businesses dont know how to adapt and make money when people pirate their stuff. It is possible to do it tho, businesses and people just dont like widespread change in consumer behavior
The laws they are using to do this are from the war against the drugs and were solely intended to be used against drug-cartels. Kinda makes you wonder what they are going to use the anti-terror laws for.
I think Chris Dodd may have had something with the recording Industry lawyers being put in place at the justice department before he joined the industry. Something about Chris Dodd just desn't seem right. I smell corruption
Trial first, no that would make sense, we dont do things that make sense anymore. Big government do sense when it makes sense to them, alterior motives. Lol due process, naa no one canbe bothered to get off there fat ass and do something about it.
So the data is deleted by the storage cos. and there's a good chance Megaupload eventually wins on appeal if convicted and sues (lack of due process). And then if the government is forced to pay damages for its illegal bungling of this to Megaupload, guess who pays for the very expensive settlement? We, the taxpayers. It won't be the gov't guys who broke the law who pay. They are very nonchalant about your tax dollars in this case. After all, it's not their money, so they don't care.
@amfanmagician The fact that they used our tax money to conduct this investigation and raid to begin with is maddening. The freaking content industry is lobbying our government to use our tax dollars to shut down companies illegally instead of suing and doing it with their own money. That's what should piss everyone off. We bigger things to worry about then this. Everyone should boycott all of the fuckers,
@amfanmagician Not only that but all the data that is being destroyed is not just pirated material. Alot of legitimate business that used it, as well as personal users just lost a heck of alot of data.
@mwhitten77 You are saying that millions of people aren't in the streets everyday in the United States? Because they are...think of New York, Houston, Los Angeles...big cities...I mean, there are PEOPLE in the streets...I just don't understand what you are saying people should go do in the streets. I guess I'll just wait for summertime, like you advised.
@youngbuck189 Um, so, if I make a movie or write a song, people should just be able to watch it/listen to it for free and just give it away to everybody?
Megaupload is awesome, corporations wrote copyright laws. "Intellectual property" is literally nonsense crafted by corporate power to protect all their investments, while squeezing out any innovation.
Trademark and patent laws are just the same, it's nonsensical garbage. People from 50 years ago would not understand how the arguements for these things because they make no sense. Now people have been so brainwashed to protect corporate power(Hollywood, Recording Industry, Drug Companies).
Before the prohibition act of 1918, anyone could build a car from a local machine shop that ran on ethanol. Once prohibition was abolished, there were only three car companies and a petrodollar based economy. an infodollar based economy is where we're going, because you can't transact on the internet if you can't get your site up, or get access to online markets. And this is going to be the mafia tactics we see to take down data based services from now on. So...DON'T CLOUD your projects.
They should have it backed up on their computer. I'm really tired of TYT defending this shit. There are already many ways where people can "share" their personal data over the Internet. File-sharing programs like Megaupload allows people to steal, and you're retarded if you think people are using it for anything else.
@mwhitten77 TYT qualify as retards in my book. They have the mental capacity of the average football fan and are not competent enough for political coverage
@mwhitten77 A couple of corrections: Megaupload is an online storage service, not program. It allows anyone you permitted to access the stored content, and that's where the sharing aspect comes in. Copyright violation is not the same as theft, please use the correct term. If I take your bicycle, that's theft, because you were deprived of its use. If I go home and build a clone of your bike, you still have yours. I made an unauthorized copy, I didn't steal yours.
I feel bad for the legitimate users who foolishly didn't keep backups. If the government actually cared about anyone, they'd put the site back up for 24 hours for people to get what they need.
EXACTLY ANNA! Anna for the win! She hit it right on the mark, thats what their game really is. If Mega loses their non-pirated material, they won't have the evidence they need to defend themselves in court and the fucking prosecutors know that shit. I'm so sick of the rampant corruption in our government...isn't it about time we do something about this? No more fake occupying either...its time to get real!

@TheHerbulator I have no problem with the Internet. I think it's great. I love being able to download music THAT I BUY, watch movies THAT I PAY FOR, play video games online THAT I SUBSCRIBE TO. These are great innovations. Theft, however, should not be tolerated.

Why would you want programs like Megauploads to continue?
mwhitten77 3 weeks ago

@mwhitten77 You're absolutely correct. What MegaUpload did can't be defended.

JoeKickass324 3 weeks ago
@Badchoicesmade I've heard that argument before too. The problem is that Megaupload takes no action to ensure that people aren't using it to break the law. If you're an artist and you want to share your music for free, make your own web-page, or create a Facebook page. But the fact that some people may use it for that purpose doesn't negate the fact that so many more are using it to break the law.
mwhitten77 3 weeks ago
@mwhitten77 They took action though, they gave copyright holders the ability to take down infringing material. They didn't however unlike youtube give them the ability to run bots.
Taiolu 3 weeks ago
@lambofreak55 They aren't websites, they're programs, and whether it's a by-product or not, it's still illegal. People who use the program in the manner in which it is intended can more easily break copyright laws. If it was only intended to put your file somewhere without having to transfer it, then why are other people allowed to access it?
mwhitten77 3 weeks ago
I honestly don't think that TYT understand how these file-sharing programs work. If they did, they wouldn't be defending Megaupload. This matter has nothing to do with the freedom of the Internet; it's about programs that by their own design make it easier for people to violate copyright laws and do nothing to try to stop their programs from being used as such.
mwhitten77 3 weeks ago
@mwhitten77 Thats not exactly correct. These websites are not specifically designed to allow people to be able to distribute copyrighted material, its just an unfortunate by product. What the website is, is they say "here you can put your file here without having to transfer it manually, and without anybody invading your privacy and checking everything you are sending" it is literally like an online post office.
lambofreak55 3 weeks ago
@mwhitten77 It's true that Megaupload does have copyrighted material, but it also has a decent amount of artists trying to get their content out. I've seen a lot of artists using sites like megaupload and soundcloud to upload their music so they can give it to their fans for free.
