Take manslaughter out of the equation and just look at the crime of murder where the intent is to kill, and still distinctions are made. Intentionally killing your wife upon finding her in bed with someone else can be considered a "crime of passion" and the degree of punishment will be lessened, So crimes are punished with motive being a consideration.

If it was a premeditated action (intent to kill) vs a spur of the moment reaction (crime of passion, intent might not have been to kill but the severe reaction led to that person's death). All the examples he's given (children, animals, corpses) run into the problem of consent. Minors cannot legally give consent. Animals are not capable of giving consent. And obviously, corpses cannot consent (unless it was in the person's will, which would be an interesting court case.)

we're at a semantic disagreement here. the way I'm looking at it, there is a difference between intent and motive. the differences between manslaughter and murder are intent. did you intend to kill the person, to injure them short of death. involuntary manslaughter is killing someone without intent to do so. Motive is completely different. Motive is like you killed your wife because she cheated on you or she burnt your toast this morning. Those are motives. Because someone is gay would be motive

Take manslaughter out of the equation and just look at the crime of murder where the intent is to kill, and still distinctions are made. Intentionally killing a law enforcement officer, for instance, has a higher degree of punishment than killing "average Joe" on the strret. Intentionally killing your wife upon finding her in bed with someone else can be considered a "crime of passion" and the degree of punishment will be lessened, So crimes are punished with motive being a consideration.

If it was a premeditated action (intent to kill) vs a spur of the moment reaction (crime of passion, intent might not have been to kill but the severe reaction led to that person's death). I know motive is involved, I'm just saying there's no reason for it. If it's premeditated, it shouldn't matter if it is bc she cheated or makes bad toast, it's still murder.
