There's a difference between a negative ad and an attack ad. Someone telling you that your Health Plan won't work could be construed as negative but someone saying that you're "too risky" is an attack ad. It doesn't address perceived fundamental flows in someones political policy but rather attacks that person.

A negative ad is any reference to the negative aspects of an opponent or their policy rather than focusing on the positive aspects of one's own attributes or policies.

This can be done by pointing out deficiencies in someone's Health Plan, or saying they are "too risky." Basically, if it's not addressing one's own positive aspects, then it's negative.
