NeoMedia Technologies grandfathered this technology back in the mid 90s and have been doing mobile code scanning and comparison shopping via barcodes long before any other company in this space.
NeoMedia has a rich patent portfolio that covers scanning barcodes with a camera enabled mobile device to connect to the Internet, comparison shop, and/or retrieve online content.

NeoMedia respects the USPTO's findings & will leverage this opportunity to respond to the ruling & defend the patent that it believes valid under patent law. The company has been requested to respond to the USPTO by providing clarification & comment on the cited prior art references by Sept 3 2008. Based on prior successful patent defenses NeoMedia is optimistic that the single patent in question will be confirmed & the reexamination effort will have served to verify the strength of the patent.

The EFF requested that these patents be reviewed as part of one of their lawsuits and the USPO revoked the patents upon further review
They would be in violation of NeoMedia's patents if NeoMedia still owned patents to the technology... they no longer do... and never will again
