  • Alito didn't say that being white and having the experiences of a white person would lead him to issue better rulings than being Latina and having the experiences of a Latina woman. If he had said that, he would've been immediately branded a racist (by the very same hypocrites who're defending Sotomayor) and his nomination would have to be withdrawn.

    Sotomayor is a racist. She said that being Latina, and having the experiences of a Latina, would lead to making better decisions. That's racist.

    No, she did not make a mistake. She knew what she was saying, and she meant it. She didn't just make that statement once; she repeated the statement in a peer-reviewed law journal. When she said she made a mistake, she was lying.

  • She's the victim of editing. She was talking about experience in the context of race, not about race itself. She said, in short, that latina women who are "wise" and have experience will make better decisions than white males *who lack experience*.The parts of her quote that made this clear were edited out by practically everyone to make it shorter and more to the point they were trying to make.

    The question being asked of him was to answer his critic's who claimed he wasn't senitive to minorities.

    It was not about how like in Sotomayor's comment, he arrives at rulings of cases he's reviewing.

  • No he did not mention those specific things, but he did mention that he would make decisions based on how he feels about the situation (empathy). The racist comment was a joke and anyone who takes my joke seriously needs help.

  • Your joke was obviously a ploy on how people are saying Sotomayor is racist, but it is a bad joke because it wasn't about her saying that she uses life experiences to make decisions, it was about her comments on how one race is going to make a better decision than another.

  • She didn't say one race or gender, but some members of that race or gender who have had those experiences. This wisdom was not inherent in the race or gender, but learned. It is the difference between street smarts and book smarts.

  • What is the use of comparing two races or genders if the only difference she meant to talk about was their level of knowledge? She might has well said that one person with knowledge vs another person without knowledge is better. Although a judge shouldn't favor a group because of personal reasons, their purpose is to hand out verdicts based on the law as written in the most neutral way possible.

The point of race and gender was that they would have experienced the law differently. In the immediate context the application of the law relative to the 14 amendment.     That's all it says. The federal govt reserves this right. "Free State" is referred to throughout as the collection of the 13 colonies.
