  • The supreme court has ruled that in pubic areas there is no reasonable expectation of privacy. If someone comitted a crime on video on a public area that video wouldn't be considered inadmissible but according to these hypocrites if you record a police officer committing a crime it's illegal.

  • What legitimate reason could a LEO have for ordering (or even desiring) a recording device to be turned off? There is none. It can only be a desire to act in a way that is at very least inappropriate, at worst criminal. I am NOT against LEOS acting in a lawful manner in ANY way: just those who are abusing their citizen given power. If a LEO asks that a recording device be turned off they are admitting that they are about to be unlawful. Every time.

Walking up to my vehicle, especially for officers of the law, I take to consider as consent and I took the liberty of lighting it up too"

  • First off, from a Legal Stance, certain rights do not apply to cops when on duty, from the point they put the uniform on, to the point of when to take it off, their rights to a reasonable expectation of privacy is just as low as when they are out in public, If you were to walk up to me and ask questions, the most I could do is decline to speak.

  • I'm sure this has not gotten past anyone, but I find it curious that an officer would request that you not audio/video record any and all interactions with the public. This creates an indisputable record of events that can later be used to either prove someones liberties have been violated but just as well can prove on the officers behalf that nothing of the sort happened. I would think an officer would welcome proof that they conducted themselves professionally and within the law.

  • Here in Illinois, it's an automatic felony to film or audio record any law enforcement office, even in a public setting. In this state, you have no rights.

  • It is your firt amendment right to film ANY police in a public setting especially when he is on duty. It is against your fourth amendments rights for the cop to try to TAKE your camara. This has been ruled by several federal courts. It has also been decided that if a cop arrest's you for filming him, He can not claim immunity later from law suites for not knowing you first amendment rights. The guy filming does NOT NEED authorization in public. Know your rights people

  • @RidleyReport It's disturbing how since you've made this there have been several cases of people being arrested and charged with crimes for videotaping/audiotaping police. It's obvious that the police get away with being corrupt, but they know videotaping would make it more obvious and they can't have it. I believe some states are trying to pass laws that protect them even more with this sort of thing.

  • There has been a precedent set on this statute. A guy got arrested and charged with the wire tapping law because he was overtly video recording the police. The judge said it was not wire tapping because the cops couldn't expect privacy in a situation that was outside in public and threw the case out. The guy did have to go through the hassle of the legal issues and the hassles by the cops. Like you said, if you offer any hassle at all you could get had for many things just to make your life hell
