The second is from season 4 was called Singled out

The photo before the song starts is not a TIVA kiss. It's a still from the episode 'Recoil' where Ziva goes undercover as 'Gina'. She kisses the suspect. Someone did a very good job of altering the still to make it look like Tony. It's a good manipulation but clearly it confuses people which was probably the purpose.
