No, it's true this song wasn't stolen, but it's obviously a hit, Avril sacrificed it. It's a very strange situation because the public has never heard Avril's full version, which means Samantha Moore or Kelly Clarkson got the rights to the first release, which means Avril as copyright owner would have had to give up those rights. That's something Arista couldn't take from her, unless this version is considered a cover, in which case Avril couldn't prevent them from recording.
