Credit/Debit cards should just go away. Now the government has your unemployment compensation and child support payments going directly to a debit card. Look up Eppicard complaints/scams online. Consumer Affairs has a legnthy list of people that are being taken advantage of in the times where they need it most. Charging people .50 cents to call the customer service number that is uncalled for. Bank of America isnt the only crook, look at your own government. greed will be the death of you
@Acrimonator Then don't use a bank! Nothing in life is free. If you don't want what services banks offer then don't use them. Banks (as well as retail and restaurants) have the right to charge whatever they want for their services. YOU have the right not to use them as a customer (or shop/eat at a particular establishment). You can't tell a business how they can do business. And by the way, Dick Durbin allowed for this to happen! Him being elected is fucked up!

Update: Bank of America has decided not to pursue the $5 Debit Card Fee. As of this moment that fee will NOT be implemented to any BofA customers that use your debit cards. Thank you.
I forgot that it was the purpose of Congressional representatives to speak negatively about a business in a way that costs American businesses money that they use to employ people. Are there overpaid executives at the top of big companies? Absolutely. But they're not going to be the ones who feel the burn of this idiot flapping his gums.
In 8 years, I haven't paid a dime to BOA, have had easy access to my accounts, and dealt with friendly and professional staff. That costs money.
@Buxterminator Thank God somebody gets it. Dick Durbin is a socialist ninny just like Barney Frank and Chris Dodd. Durbin made these comments just as banking legislation is about to take hold which will essentially make retail banking very costly for lower-middle class and middle class customers. People who don't have checking accounts ... and pay their bills in cash ... won't be affected by these clowns. The health care law gives the IRS access to your checking account. Wake up, people!
@jessefry "The health care law gives the IRS access to your checking account" that is a straight up lie or you believe it because some right winger you agree with said it. That is simply not true, the IRS has nothing to with a person's personal finances; thats idiotic but it doesnt matter wat i say, ull still believe this bullshit. people like u are just hopeless, sad and pathetic really. There's the link to the health care law. The part of the law that gives the Secretary of DHHS the means to access your finances starts on page 58. Read it for yourself. Signed: just hopeless, sad and pathetic really
Bank of America HAMP scam is over.... I hear they are closing up shop within the next few weeks. All customer accounts are to be frozen and the CEO to finish up business. They made it look so easy to scam the elderly out of homes and the government out of program money without helping a single soul. All money collected by the bank for HAMP went towards interest only (no principle was paid on).
The big banks are for-profit corporations. They have a right to charge whatever they want for their "product". As a consumer, it is your right and responsibility to do your homework and choose the best product (bank) that meets you and your family's needs. If BofA wants to become the "Bank of the Wealthy" so be it. Take your business elsewhere. Durbin did a good thing - shook up some cobwebs in the banking industry.
I love the entitlement attitude of BOA customers. They're a business, they have the right to charge $1000 per month if they so choose. A consumer has the right to take their business else where. DON"T USE THEM! Banks aren't free! Use cash only! Another example of how our society has turned into an entitlement country!
banks should be able to charge for the service they provide. This guy just wants you using a government card someday. Imagine how much that will suck, they fuck everything up.
CharterOne bank give money back do you for using your debit card! Great bank, I've been a customer for 7 years now. Everyone should switch to CharterOne! Called "Citizen's Bank" on the East Coast.
I also want this kind of study done on why people are charged to cash a check AT THE ISSUING bank because I didn't have an account with them! The person who wrote the check was with me and became so enraged, he closed his account.
they are clearly struggling to make new revenue bc they are limited by regulations etc. and whats worse....others are testing this out...fuck I WILL KEEP MY PAPER UNDER MY MATTRESS IF I HAVE TO I DONT REALLY NEED A BANK
"The debit card purchase monthly fee is charged when making PIN or signature-based point of sale purchases in-store, by phone or online."--BOA
So customers (myself included, unfortunately) aren't being charged for *having* a debit card, only for using it for purchases. On the bright side, the fee is somewhat in your control. However, to avoid that fee means living without plastic, so out goes shopping online (at the very least).
@bigjewgeek Here's the thing: those account maintenance fees are easily avoidable if you meet certain criteria, be it using self-serve only options, or maintaining a minimum monthly balance in the account. There are different accounts that are set up to meet different needs. You can find the listing of maintenance fees for personal checking accounts on their website.
I have a bank of america card alone with all my family about ten of us as soon as they start charging we are closing them down. Thought bank of america was looking out for the people what a diappointment. DONT support bank of america hope they crash
Bank of America charged my friend $2,000.00 in fees on a $400.00 credit card balance (over a year) in late fees and fee's on late fee's. Because she had accidently set up autopay 2 days later than the payment date, she was never told by BofA nor would they reverse the fees. $400.00 in charges became a $2,400.00 balance. STILL WANT a BofA CREDIT CARD?
USE YOUR LOCAL BANK. BOYCOTT THE LARGE BANKS AND PULL YOUR MONEY OUT AND CLOSE YOUR ACCOUNTS. STOP USING YOUR ATM PERIOD. CARRY CASH, USE ONLY CASH. STARVE THE FEE'S OUT.
i left Bank of America in 07 i believe when i was 20... i knew they were greedy and no good then. basically for every dollar u went over on your card, there was an over draft fee of 10 dollars. so instead of owing them 30 dollars i owed them 300. i left right after and they never got that 300 dollars... greedy fucks!
BoA was forced to asorbe countywide and Merill lynch and all their toxic assets so they have a negative on the balance sheets and we as account holders are being forced to cover these debts....im outta BoA this coming week...finding a small independent bank....... its safer
Ironically the democratic party fought against the founders and the constitution to have these allowed in the system and made its as far as killing the republic ... Now they are forced to fix what they wanted in the first place. Meanwhile the republican base is destroyed with conservative idiots.
Liberty was not to allow you to manipulate and steal from the system for your own personal Greed. Especially when its deals to undermine America .. I with the founders as corporations and the Financial institutes where supposed to be kicked and barred from the country long ago.
Washington kept them to ground, Jefferson worked to run them the hell out... The constitution and the bill of rights made sure to keep them out by illegalizing any form of paper currency.
DICK Durbin is an asshole who can't get the fuck out out of other people's business. He took lobbying funds from big box retailers who are incapable of playing fairly in the free market. As a result, his actions ultimately hurt the consumer.
I'm no big bank fan but I also apply common sense. All businesses are entitled to earn a profit. If that means raising fees, so be it.
Want to blame someone for the fees? Blame DICKHEAD Durbin!
@SkyhawkFlyer ??? As English is not my native language.
I think the American people who have bankaccounts which they now in future are going to pay MORE for have to wake up. They can MAKE a difference!!! Not just sit back and wait before things are gettin´even more expensive. The $5,- fee pro month will be a start ... soon you will be charged even more
Interesting in Durbins speech that he told us about the costs of plastic money
@AngeliqueEU There is a cost to doing business. I order inventory for my business. In most cases, the suppliers pay shipping. In other cases, I have to pay for it. That's the terms of the sale. If i want their product to sell, I have to agree to the terms.
It's no different for banking. If you want to use the bank's services, you pay. Some provide it for free. Some do not.
What you fail to see, it was Durbin's own amendment to the Dodd-Frank bill that started this. Government has no place here.
@SkyhawkFlyer I have to think about this ... action & reaction... that is true. BUT a maximum fee is not bad to be set by Government. It costs them 7 cents ... why ask for 44 cents? That is just wrong ... and because of that the Government decided to put a maximum on it. It might be this senator who started it but Congress votes on it!
There is cost of doing business yes ... and those costs are within the products you buy. We all know only the sun comes up for free.
## t's no different for banking. If you want to use the bank's services, you pay. Some provide it for free. Some do not. ##
I am lucky we have a lot of different banks over here. Maybe we have more different banks than you have in the state you live. We have a lot to choose from and it is because of a LOT of customers will shop around that banks are now starting to give 1 or 1.5% interest on checking accounts. cost of an account is about 1,- a month, not 5,-
@AngeliqueEU The cost was being borne by the retailer. They bitched to government. The government limited fees banks could charge retailers. Banks owe the shareholders so they raise fees elsewhere. Hence, consumers have to pay more.
It's the cost of doing business. I had a very nice rewards program on my debit card. I lost it entirely. I don't like it but I understand it. It's entirely DICK Durbin's fault I lost this program. Not the bank's.
Government needs to butt the fuck out of my business!
Government regulates business. You bitch about it like an ignorant fool. Do you want a chemical plant to dump toxic waste into the local water supply. They would if they could get away with it, and all in the name over greater profits.
@jinto1980 I'd say you're the fool when you cannot differentiate between operating in a free market economy versus abiding by common sense environmental regulations.
Second, I'm betting you don't have a clue how this came about. Try educating yourself. I'd give you a link but it's not allowed. So, do a search for "dick durban, dodd-frank". The second link that comes up from Wizbangblog is a very good explanation.
Are you that fucking stupid??? In September alone, the Obama Admin has instituted 307 new regulations.
Are you one of those who are so stupid that you have to have government babysit you from cradle to grave??? Apparently, so! Have you ever read the Constitution? Not likely.
Do you value your liberty? I'm guessing not. So, you go on and be an absolute dumb ass and liberal idiot looking for your government babysitter.
@AngeliqueEU The free market should rule. The market works best when able to compete freely without restriction. The only government interference should be when fraud takes place. Attempting to make a profit where possible is not fraud nor is it unethical.
@SkyhawkFlyer Something for free? I had 4 business accounts with BoA and did multi million dollar years for 20 years. I got a state contractors license and another business plan to produce houses. Believe me! They are big time gangster like Dicks! That's the short version! You are a little pecker, based on your comment! You are small time Winnie like!
we've had the $5 monthly fee here in Australia for about 7 years now. They get away with it because it's tax deductable. So what, so now the tax payer is paying for it. What a vitious circle.
chase told me they were going to charge $10 a month for having a checking account with them, so i left and joined a credit union. they lost $10k that day, its not much but it adds up if everyone else pulls out of their bank and joins a credit union.
I am glad the govt is taking a step to limit the fees. Although I wish they would go after the credit card processing fees too. Our business is charged 1.8% - 3.6% for every credit transaction. Our average transaction is $2000 so we are charged $36 to $72 per swipe... That adds up way more than the Debit card fee which I believe is a flat fee of $0.44 unlike Credit transactions which are a percentage.
@TheColdfriction ... IF I was 100% sure you will pay me back I´ll give you the $ 100 ... and that 10 extra comes from you ....... not out of thin air. BANKS on the other hand can lend out money they do not have ... which doesn´t exists ..and that put us all into these economic problems
The joke is that it's the reciever of the money who pays.. It's like the stamps on letters has to be payed by the one reciving it, instead of the sender. So there's no incentive to only use it when nessecary
Took me minutes to open an account at Delta Community Credit Union, which was just one of several options here in Atlanta. I get a no-fee debit card, which can be used in a network of Credit Union Co-op ATMs, and a savings account... both of which will pay dividends at a rate higher than anything I had at Wells Fargo. Overdraft fees are cheaper than at Wells Fargo. There is little to no reason not to leave your bank if they're charging you money, even if it's just a little bit of money.
5 bucks. who cares. im sure all of you have wasted a lot more money on worse things. i know i have. starbucks coffee is 5 bucks or more but people still buy em more than they should. its a business that provides a service. you cant go anywhere to get any service for free. 5 bucks is not that much.. seriously.
@lavender1905 Actually, they are allowed to create money (when giving a credit) up to a certain ratio to the funds they have on deposit. So, they're not lending what others deposit, but it is the basis upon which new money can be created. Which happends every time someone lends money from the bank. Through credit cards, morgages, whatever.
@sug4rb0mb yeah except it all adds up. 5/mo. X 12 months = $60 a YEAR - just to use your debit card. Not only that - but I know my bank and many others are ALSO charging a $12 or so per month fee just to HAVE an account now. Banks are doing away with free checking in addition to these new card charges per month. In total, just to recap - that's $12 X 12 months = $144 per year just to have and maintain a checking account. Altogether, that is $204 extra in new fees per year.
@sug4rb0mb ... and that figure doesn't include the *hidden* fees most banks carry as well (check image fees, transfer fees, ATM fees, some even charge now just to recieve an account statement in the mail every month instead of banking online), nor does it include their random charges. Banks are grossing a bare minimum of $200 (often more than twice that amount by the end of it) per person, per year - JUST to allow people to have a checking account and use their debit card.
@sug4rb0mb How you manage your money is your business, but there are a lot of people out there who can barely afford the bare necessities right now, let alone $200+ for no real reason at all.
@sug4rb0mb For you 5,- might be not much money. But there are a lot of people who cannot really miss out on those 60,- a year. Think of people with jobs at 7Eleven or what ever company who pays not a real good wage. And without a bankaccount anno 2011 is not to be done anymore. You need a bankaccount. Also caused by the banks and in future this will be even more so. Companies will pay your salary into your bankaccount only not by check or cash.
@gmo8492 Remember that they use "your money" and INVEST it. They make money on your money. Then they charge you to use your money that you give them to make money with. It's enraging.
So sad, we need to finally recognize what's happening to us. Consumers and retailers alike are being abused by these institutions, and the government that allows this to happen.
By the way, NO WAY IN HELL, that retailers will lower their prices. Durbin is supposedly lowering fees for retailers, and his argument is that this will help consumers. Bullshyt !!! Walmart and Target et all won't lower crap. They'll simply add that extra income to their own books.
So, the banks can't make 44cents on something that costs 7cents. But, our senators can make hundreds of thousands of dollars and get lifelong pensions, and they don't even have to balance the budget??? GTFOH !!! I'm not forgiving the banks, but quit being hypocritical, Durbin. All this "help" you're giving, is simply making the banks charge more for other products and services.
Maybe we should have just mandated that Master Card/VISA be forced to save half their profits to pay for a national conversion to a chip-and-pin card system. This is a serious security issue and we as consumers NEED this change...I believe the threat is serious enough to mandate the industry to fund a national change to a chip-and-pin system from their profits. We are looking at a scale of fraud that isn't discussed near enough...esp with Europe moving to chip-and-pin systems to curb mag fraud
Banks and WallStreet are the polished versions of loan sharks / bookies. They make the money on the streets from the people, then kick up a percentage to the Capo's and the Don (Senators/Reps/Gov't in general) so that they can continue to operate their biz.
Listen to this man, I had a horrible experience with BOA. Then they listed me in Chex Systems unfairly because I wouldn't pay all thier overdraft fees which came to $300!!! I paid it all but because they were so slow to post my payment of their fees that they put me in Chex System so that other banks will turn me down for loans.
The slimy politicians get up in arms about these, basically, nickel and dime fees. Where is the outrage regarding the national that they say WE owe (and we do not) and all the trillions they piss away by the minute? Smoke and mirrors by the master liars.
Considering that these transactions are all computerized/digitized, where the hell the need for a fee? All bogus, more ways to extract money from the people.
I closed B of A credit card account a couple of months ago because they added a fee to that. I'm still paying off the debt, but they are getting no extra money from me!
I already left Bank of America a couple years ago and am using a Credit Union (many of which are not-for-profit). Their services are MUCH better and fees are MUCH lower.
People need to also demand that their employers go back to paying them with a check rather than direct deposit. It costs the banks way more to cash a check. Fight back folks! Get your cash out of this bank NOW and join a credit union if you can - or use your small local bank!
@Chumppi ..for not regulating the banks and for taking the bribes (they call them "campaign donations") that coerce them into allowing all these bank/billionaire favoring laws to pass legislation without the consent of the American population. (just wanted to clarify for the sake of purpose.)
@tippingpts My local community bank is the shit....find a local credit union, they are non-profit and banking should be a non-profit industry, just like healthcare WAS before Medicare and Medicaid...you are more likely to DIE than receive medical care compared to the 60s and before, you would always find a way to treat someone because they were non-profit. Their only concern was the patient and doctors made $3/hr.
I love the outrage of these individuals wanting something for free. Banks have the right to charge you $100/month for debit cards it they want. A consumer has the right not to use that bank. When all banks, and they will, charge for this service, then what will you do. Another example of entitlement!
I closed my big bank accounts 15 years ago and joined my local Credit Union where I have been treated with dignity, respect and pay no fees. I take loans out with no hassle, maintain my credit, and give my credit union all my business. I discontinued all my credit cards years ago... and I am happy as a lark! :) Smarten up America... stop getting duped by the big guys. You don't need those abusive UBERS.
I closed my BoA account yesterday and went to Travis Credit Union. I now have free checking, better customer service, and no monthly charge on debit card use. Fuck you, BoA.
News Flash Dick Durbin is not SAINT Dick Durbin. He brought this NIGHTMARE upon Bank of America due to his amendment he put in the Frank/Dodd bill that passed. So i wouldn't call Dick Durbin a "hero". He is a MOTHERFUCKER.
@computerpurple Are you an Idiot? Durban put it in that amendment AT THE REQUEST of American consumers who were shocked to learn that all of the banks put together last year took in 29 BILLION in late fess erroneous overdraft fees.
Businesses also complained about the banks too, my grocery store in Idaho stated they could and would have lower prices but the banks were charging them .50 per transaction so they stopped taking debit cards at all Winco stores.
@MrYoubrian I disagree with you about Dick Durbin. He is not exempt for this mess , for it is Dick Durbin's amendment that caused this domino affect. You said - "AT THE REQUEST of the American consumers"..OH PUHLEEZE Durbin is not a poor wittle victim , he is a legislator agitator.
@computerpurple You seem to have forgotten the national discussion that we had to tell all of our senators that we were unhappy with the exorbitant bank charges of fees. US BANK and Wells Fargo were charging me about $400.00 a year in late fees. They got caught changing the due dates on peoples bills so they could charge them late fees.
If your bill was due on the 15th one month, the banks would change it to the 10th the next month resulting in 29 billion dollars a year of profit.
@computerpurple AHHHHHHHH! Now you are started to catch on. He tried to do good and did the right thing but the banks are crafty and are trying to circumvent the new law about debit fess.
It is what banks and other big corporations have been doing for decades. You write a law to fix something and they work to get around it. It is a never ending cycle. Same thing with the speculators on wall street who drive prices up everyday.
This does not mean Durbin did not at least try to right a wrong.
@MrYoubrian Typical liberal speak / observation... results don't matter as long as good touchy feely intention were made. What Dick Durbin did , did NOT help.

DON"T USE THEM! Banks aren't free! Use cash only! Another example of how our society has turned into an entitlement country!

However, to avoid that fee means living without plastic, so out goes shopping online (at the very least).
zomgwtfbbqwaffle 4 months ago
@bigjewgeek Here's the thing: those account maintenance fees are easily avoidable if you meet certain criteria, be it using self-serve only options, or maintaining a minimum monthly balance in the account. There are different accounts that are set up to meet different needs. You can find the listing of maintenance fees for personal checking accounts on their website.

DICK Durbin is an asshole who can't get the fuck out out of other people's business. He took lobbying funds from big box retailers who are incapable of playing fairly in the free market. As a result, his actions ultimately hurt the consumer.
I'm no big bank fan but I also apply common sense. All businesses are entitled to earn a profit. If that means raising fees, so be it.

Interesting in Durbins speech that he told us about the costs of plastic money
AngeliqueEU 5 months ago
@AngeliqueEU There is a cost to doing business. I order inventory for my business. In most cases, the suppliers pay shipping. In other cases, I have to pay for it. That's the terms of the sale. If i want their product to sell, I have to agree to the terms.
It's no different for banking. If you want to use the bank's services, you pay. Some provide it for free. Some do not.
What you fail to see, it was Durbin's own amendment to the Dodd-Frank bill that started this. Government has no place here.
SkyhawkFlyer 5 months ago
@SkyhawkFlyer I have to think about this ... action & reaction... that is true. BUT a maximum fee is not bad to be set by Government. It costs them 7 cents ... why ask for 44 cents? That is just wrong ... and because of that the Government decided to put a maximum on it. It might be this senator who started it but Congress votes on it!
There is cost of doing business yes ... and those costs are within the products you buy. We all know only the sun comes up for free.
AngeliqueEU 5 months ago
@AngeliqueEU (2) but costs should be FAIR .... cost 7 cents and fee 44 cents is not fair!

## t's no different for banking. If you want to use the bank's services, you pay. Some provide it for free. Some do not. ##
I am lucky we have a lot of different banks over here. Maybe we have more different banks than you have in the state you live. We have a lot to choose from and it is because of a LOT of customers will shop around that banks are now starting to give 1 or 1.5% interest on checking accounts. cost of an account is about 1,- a month, not 5,-
AngeliqueEU 5 months ago
@AngeliqueEU The cost was being borne by the retailer. They bitched to government. The government limited fees banks could charge retailers. Banks owe the shareholders so they raise fees elsewhere. Hence, consumers have to pay more.
It's the cost of doing business. I had a very nice rewards program on my debit card. I lost it entirely. I don't like it but I understand it. It's entirely DICK Durbin's fault I lost this program. Not the bank's.
Government needs to butt the fuck out of my business!

There is little to no reason not to leave your bank if they're charging you money, even if it's just a little bit of money.

sug4rb0mb 5 months ago
@sug4rb0mb You ARE aware that banks make money by lending out the funds they have on deposit, no?
lavender1905 5 months ago
@lavender1905 Actually, they are allowed to create money (when giving a credit) up to a certain ratio to the funds they have on deposit. So, they're not lending what others deposit, but it is the basis upon which new money can be created. Which happends every time someone lends money from the bank. Through credit cards, morgages, whatever.
argh523 5 months ago
@sug4rb0mb yeah except it all adds up. 5/mo. X 12 months = $60 a YEAR - just to use your debit card. Not only that - but I know my bank and many others are ALSO charging a $12 or so per month fee just to HAVE an account now. Banks are doing away with free checking in addition to these new card charges per month. In total, just to recap - that's $12 X 12 months = $144 per year just to have and maintain a checking account. Altogether, that is $204 extra in new fees per year.
babygirladdy 5 months ago
@sug4rb0mb ... and that figure doesn't include the *hidden* fees most banks carry as well (check image fees, transfer fees, ATM fees, some even charge now just to recieve an account statement in the mail every month instead of banking online), nor does it include their random charges. Banks are grossing a bare minimum of $200 (often more than twice that amount by the end of it) per person, per year - JUST to allow people to have a checking account and use their debit card.
babygirladdy 5 months ago
@sug4rb0mb How you manage your money is your business, but there are a lot of people out there who can barely afford the bare necessities right now, let alone $200+ for no real reason at all.
babygirladdy 5 months ago
@sug4rb0mb For you 5,- might be not much money. But there are a lot of people who cannot really miss out on those 60,- a year. Think of people with jobs at 7Eleven or what ever company who pays not a real good wage. And without a bankaccount anno 2011 is not to be done anymore. You need a bankaccount. Also caused by the banks and in future this will be even more so. Companies will pay your salary into your bankaccount only not by check or cash.
now it is 5,- a month. but in future?

This is a serious security issue and we as consumers NEED this change...I believe the threat is serious enough to mandate the industry to fund a national change to a chip-and-pin system from their profits. computerpurple 5 months ago
Don't blame the representative!

computerpurple 5 months ago
@computerpurple You seem to have forgotten the national discussion that we had to tell all of our senators that we were unhappy with the exorbitant bank charges of fees. US BANK and Wells Fargo were charging me about $400.00 a year in late fees. They got caught changing the due dates on peoples bills so they could charge them late fees.
If your bill was due on the 15th one month, the banks would change it to the 10th the next month resulting in 29 billion dollars a year of profit.
MrYoubrian 5 months ago
@MrYoubrian ...And what Dick Durbin has done hasn't helped...DUH.
computerpurple 5 months ago
@computerpurple AHHHHHHHH! Now you are started to catch on. He tried to do good and did the right thing but the banks are crafty and are trying to circumvent the new law about debit fess.
It is what banks and other big corporations have been doing for decades. You write a law to fix something and they work to get around it. It is a never ending cycle. Same thing with the speculators on wall street who drive prices up everyday.
This does not mean Durbin did not at least try to right a wrong.
