That's not true; the balistics test showed that it was a 38 that was the murder weapon. It was just an inexpert opinion of a doctor that it looked like a 44 wound.

It was a high powered 38, so it appeared to be a 44 to the doctor. But the trial is based on hard evidence. So the balistics test is by a ballistics expert.
