The Chinese claim of the whole SCS is backed by acquiescence of the US who supplied all the ships required for the Chinese to take over big islands. Neither the US nor the Spanish ever claimed Spratly as part of the Philippines, so their claim is the most dubious. The real issue for the US in SCS is that commies want to redefine the meaning of EEZ into territorial waters. Given the strategic importance of SCS as trade route, this is not going to happen.

The ownership of Spratly can be traced back to the end of WW2 when both France and China (not commie yet) claimed sovereignty. France backed out in exchange for Chinese recognition of French authority to be restored in Vietnam. Under the US support, South Vietnam occupied part of Paracel (with the biggest island in commie hands, and most of Spratly except the largest two islands. After US withdraw, commies took over all Paracel, but Vietnamese commies betrayed Chinese commies on Spratly.

@Prophet4YAHWEH Vietnamese commies accepted Chinese commies' view on SCS before they defeated the legitimate government of Republic of Vietnam. At least that was what they told the Chinese commies in 1958. After that, they took over what's still under former ARVN control and claim both Paracel and Spratly as Vietnamese territory. But you can't say Chinese commies were fooled. They attacked ARVN positions in SCS in 1974. They just didn't have the military might they have today.

Also, The Vietcong leader who "gave" those islands away to the chinese violated another important matter: he gave what belonged to another nation. The Vietcong leader in Hanoi was in charge of North Vietnam while those islands belonged to South Vietnam.

So china is clearly in the wrong & must IMMEDIATELY give those islands back to Vietnam.

In the end of the day you can say that China is wrong, China was the only country both claimed and made efforts to effectively occupied Paracel and Spartly. The occupation troops in Paracels rebelled to the commie side, that's why ROV, under the support of US military, occupied parts of the Paracel after independence. Chinese commies sure aren't stupid, so they made the move after the US left ROV to fend for themselves. To them, they think they were taking back what's theirs, robbed by US imperialism.

Only after China fell to commies did the US supported the actions of French Indochina and later ROV actions. Chinese claim of SCS can be traced back to 19th Century.
