The reason why this isn't on Rock Band is because you gotta buy it in the Xbox Live Marketplace and also the notes look different because this is a BETA (pre-released version/test) of the game

This song isn't available for purchase on the Xbox Live Marketplace or Playstation Store. I think that it was a song that they REALLY wanted to include in the retail version of the game but couldn't work out an agreement with rights/licensing, so they just used it in the beta.
