The statute, SPB 111.20 does not appear to apply in this situation. It's pretty clear that the law is aimed at pre-scheduled large scale events, for which the statute requires approval by the State Preservation Board (SPB). In order to obtain approval, the event sponsors must ask 3 weeks in advance; "event" is "[a]ny performance, ceremony, presentation, or activity held on the grounds."
A spontaneous, small-scale demonstration of the sort in this video arguably does not fall under the statute.

How much time is required between 'events'... can people leave for a half hour and then comeback and start a new event. The officer said that the time starts once someone shows up...is there a limit to the number of events per day or certain times that events can occur.

Texas Government Code Section 443. Sec. 443.018. REGULATION OF VISITORS AND VENDORS. clearly states: "(e) This section may not be applied in a manner that violates a person's rights under the Texas Constitution or the First Amendment to the United States Constitution, including the right of persons peaceably to assemble."
@LainieDuro This is the statute that gives the TPB the authority to create it's rules [housed in the Administrative Code]. This statute defines that the rules made [i.e. 111.20] cannot violate first amendment rights. They should have fun with these lawsuits.
Okay, I did some research on this, and it's not a freedom of speech issue. But the cops were wrong in their explanation. All 'events' on Capitol grounds should be less than 3 hours long, according to the "Use of the Capitol Grounds" part of the Texas Administrative Code.

I last saw this Texas-type police behavior in communist East Germany in 1989. In 1989, the Stasi employed 91,015 persons full time, including 2,000 fully employed unofficial collaborators, 13,073 soldiers and 2,232 officers of GDR army, along with 173,081 unofficial informants inside GDR . Their job was to stifle any political opposition to the people in power. God- how soon we forget.

@wmarcus I'm unconvinced that free markets would provide access to healthcare food and a decent education to all children. With the limited regulation the markets have now, they cause vast economic inequality, a lack of adequate healthcare, and Universities with out-of-control tuition costs that are being paid for by the next big bubble - student loans.
Also, please don't talk to me in "shoulds." It's condescending and presumes that you have answers that I have not considered.

@LainieDuro Healthcare is one of the most regulated fields. Government also is very involved with Universities and student loans. Strange how government intervention is most prevalent in the areas that need the most reform.

@LainieDuro Supply and demand. The fact that you have considered something does not mean you have come to the correct logical conclusion as you propose. You should consider the laws of supply and demand. With more access to healthcare without a counter balance the cost will rise because there will be more demand. Your desired goal of more access to healthcare & education is the reason it is more expensive because there is more demand.

@LainieDuro Markets aren't inherently capitalist. Mutualism retains a currency system like capitalism but without the property ownership rights that would allow food and healthcare to be privatized. Also work places would be coopted and non-privately owned.

@ylloyd we were told that we would be cited if we came back, even if we left our signs behind. We did not ask, nor were we told, what time limit in between "events" was allowable. It's basically completely bogus and indefensible. Clearly the cop was just stating what someone told her to tell us. She knew as well as we did that it wouldn't stand up in court, but it did get us off of the property, because none of us could risk it at the time. I'm certain there will be more pressing of this issue.

How much time is required between 'events'... can people leave for a half hour and then comeback and start a new event. The officer said that the time starts once someone shows up...is there a limit to the number of events per day or certain times that events can occur.

The question is...is free speech an event? Or does it fall under this statute:
Texas Government Code Section 443. Sec. 443.018. REGULATION OF VISITORS AND VENDORS. clearly states: "(e) This section may not be applied in a manner that violates a person's rights under the Texas Constitution or the First Amendment to the United States Constitution, including the right of persons peaceably to assemble."

@LainieDuro This is the statute that gives the TPB the authority to create it's rules [housed in the Administrative Code]. This statute defines that the rules made [i.e. 111.20] cannot violate first amendment rights. They should have fun with these lawsuits.

Okay, I did some research on this, and it's not a freedom of speech issue. But the cops were wrong in their explanation. All 'events' on Capitol grounds should be less than 3 hours long, according to the "Use of the Capitol Grounds" part of the Texas Administrative Code.

Free speech does not mean the right to occupy public property. They are apparently giving groups the ability to request protest time. That needs to be balanced with the right of others to enjoy that same facility w/o being bombarded by people protesting, which not everyone enjoys. The right of free speech only means that the government cannot regulate content.

anyone who has spent up to 3 minutes in law school knows that no right is absolute. there are always limits. whether those limits are fair or not is up for debate.
ps: in many civilized countries there are rules about protesting, like giving prior notice. the government can't suspend your protest because of it's content, but they restrict where you are allowed to go, and at what times

@T00LIZATION I couldn't agree more. Finally people understand we've been playing around for far too long and this is not a game to them. They are very serious. We don't show up to they're press conferences, and their natinal conventions in riot gear. But they show up to our rally's and peaceful demonstrations based on the free will they tell us we should excercise with tear gas, gas masks (for themselves), guns, tasers, battons, rubber and real bullets...it is not a game to them.
