  • I admire Markapolos for all he did but I can't help wondering why he kept on bothering with the SEC when he knew they were ineffective. Why didn't he just turn this to the FBI as it was so obvioulsy a criminal case against Madoff and save some people?

  • Most insightful part of his book is the chapter on the media not listening. Great line: "I always wonder in conspiracy movies why the hero just doesn't go to the press, get the truth out and it'll all be okay. Now I know, it doesn't work at all." And his heading of the chapter: "Did No One Want a Pulitzer?" The SEC is one thing but you'd think some reporter in nine years would want to blow this open.

  • The SEC was right where the Republicans wanted it - a government agency that services their clients - Wall Street. For that "government" gets the blame? Blame the political party that wanted a toothless agency. Had citizens (including Democrats) not bought into the Republican mantra - "government needs to get out of the way of business", not only what there not have been a Maddoff, there wouldn't have been a financial meltdown. Was that lesson learned? No. Tragic.

  • What I don't understand is this, Madoff, through his very successful brokerage firm, had access to plenty of private data on market activity, he would have been able to produce massive returns front running on his clients' trades. Perhaps it would have been immoral in some people's eyes but it wouldn't have been nearly as immoral as fabricating returns and he would probably have been sent to prison for 10 years not 150.

    That is how Markopolos uncovered the crime, he noticed that Madoff was pulling off ridiculous figures such as 20% in a year of bear markets, so he back-engineered the figures and after only 4 hours of analysis realised there was no possible way that it was legitimate and that it had to be a massive ponzi scheme.

    Over the 8 years he was whistle-blwing and deliberately being ignored by the SEC he received many threats and was told to shut-up. The SEC is criminal.

    Wall Street has proven time and again beyond a shadow of a doubt that it is utterly incapable of self-regulation. Unfortunately, the Madoff case suggests that the government's capability for effective regulation is dubious at best.

    it's easy to think that pay offs are the reason the SEC didn't move on madoff sooner, that's what I thought at first too. It's actually (surprisingly) not the case. Even Mr. Markopolos doesn't believe there were any pay offs to the SEC directly. If there were, the SEC would have given up his name to Madoff, and Mr. Markopolos probably would have either been killed or intimidated into putting an end to his whistle blowing.

  • @abetterplayer where ever theres money being made there will always be impropriety and even criminal conduct, that avenue is created with an unregulated market or rather the DJIA and brokers are self regulated. regulators like SEC , ASIC etc do not have the professional capacity or adequate facilities to examine financial market matters.

  • First of all, he tried for 9 years to get the SEC to investigate Madoff with the first warnings were sent in 1999. By 2005, he submitted a 21 page report to the SEC listing 2 dozen red flags. The SEC could not determine, for unknown reasons, that Madoff was committing fraud. The SEC is the appropriate authority to report securities fraud.

    Second he submitted to others like the Wall Street Journal who did pursue a story. MAR/Hedge did write a story.
