so if the judge ruled that the documents held no bearing due to being from another state why didnt you just say you got ALL your turtles from that state? then he would have to admit the papers. let me rephrase that since none of this sould've happened in the first place, then he SHOULD addmit the documents. if they cant use the documents in court then how can they prove how many you obtained legally or illegally?
@cgspeeddemon1 I was charged for the "possession" of turtle species that exist in the wild in Georgia. The species I had however were actually obtained lawfully in other states, but they also exist in the wild in Georgia. I have substantial evidence, some used, some never used, that proved how and where I obtained these turtles. But for the charges of "possession" the judge basically ruled that nothing from another state was relevant to the charges from this state and used a drug analogy.
@Delticola ..I dont understand the judges logic...Thats a constitutional issue in itself. Sounds like he basically is saying also...your college degree, marriage license, drivers license, any bill of sale for vehicles or other personnel property would have no standing in my court room either.
I read about this story on Turtle Forums at ATP, what a senseless waste. While I have no where near the size of this collection, only 12 turtles, all of mine are captive born and I keep all my receipts just in case idiocy like this befalls me.
@methos19751 Ah, but please take my advise. Either hide your receipts extreamly well, or take the origionals over to your best friends house, or closest family residents house. During trial I was never given access to my documents! The judge in my criminal trial specifically made a ruling that non of that material would constitute as evidence: mainly it was out of state permits and licenses for which he ruled that none of it mattered for a trial on Georgia "crimes."
@methos19751 Yes it would, and it might have been an enumeration of error for appeal if I was convicted. But I was acquitted so I had nothing to appeal. The only recourse I have is a malicious prosecution suit against the law enforcement officers and the prosecutor, but the prosecutor will likely get prosecutorial immunity because of how our local 11th Circuit Federal Appeals Court rules on that issue. Basically a prosecutor in this circuit can frame someone and is imune from lawsuit.
@TheTurtlelover09 What I mean, unless you went to the state of Mississippi and captured that hatchling turtle yourself, keep your sales receipts off property at a relatives house, in a file among their special papers. All my records and documents were seized from me and the judge would never order their return, not even for trial. The judge also ordered that out of state captures, even lawfully with licenses etc. was not a matter for a state of Georgia court, not even for a defense!
Poor turtles. I'm so sorry you got disrespected like that.
