@lovesbigfatcats Judges are usually a mirror onto others, and it's never more than case than with someone like Justice Sotomayor: the vast majority of Americans have no issue or disagreement with her (and recognize that her skin color, age, religion, etc. have no bearing on her abilities to be a fair judge) but there remains hate and racism in this country...it will take time, it has been less than 50 years since the Civil Rights protests. But we have mostly moved on.

I thought President's appointed justices as a matter of qualifications. I once said the "N" word in front of some black people. I addmitted it was a mistake and so did she with her comment. Sotomayor deserves the position - her experience and qualifications speak for themselves. But she did make a couple of comments I am sure she REGRETS now. However, we all learn and she continues to be the best candidate. After she claimed to be a "wise Latina woman" with "experience", I still think her nephews and nieces should AT the very LEAST speak Spanish. Unless she is only using her "hispanic" ethnicity as a political tool.
By the way, hombres : women don't just belong in the kitchen!

IF the white lady was as qualified and experienced as Sotomayor is, she would probably get a pass too. Trouble here is, you are looking for an EXCUSE to ERASE her qualifications and experience and DENY her qualifications. This is what discrimination is all about...UNDERMINING, DENYING AND OVERLOOKING the achievements, merits, hard-work, intelligence of individuals. You cannot deny her experience and qualifications.

I don't deny her experience. As for qualifications, I think bigotry is a disqualification. White or nonwhite, anyone who says that her race (or sex) is something that makes her a better judge is a bigot and for that reason alone shouldn't be on the Supreme Court. I wouldn't give "the white lady" a pass--and neither would you, which makes you a hypocrite and a bigot for giving Sotomayor a pass on her racism. You wouldn't do that for a bigoted white judge.

Her brother Juan Sotomayor, a doctor, only for the rich, probably does not assist poor hispanics who don't have a good medical insurance plan. Also, her nephews and nieces, none of them have a hispanic name (Tracy, Kyle, etc.) - I suppose the "hispanic" heritage will die with her generation. Do these kids speak Spanish?

No, I don't get it. I am of Russian, Irish, Italian, Native American, Euro-Spanish, Ukrainian, Czechoslovakian, and a bunch of other Eastern Euro decent. I am very multicultural. But that is worthless to me. What my ancestors did and come from has no impact on what I do and come from, and as far as I'm concerned, all that heritage could be conquered and lost tomorrow and I would go on as an American. This background of mine has no value, and the vast doings of my "people" is of no concern to me.

She is of mixed racial heritage (mostly Taino indian) as is typical of the Puerto Rican population.
You know next to nothing about Puerto Ricans. Because of economic conditions at the time, most White or Euro-Ricans can be found in Puerto Rico,while most colored Ricans can be found in New York.

As for the 2nd, have you read the opinions in the case related to this? If you had you would have discovered that if anything she is enforcing states rights

This was reinforced by Bach v. Pataki. You could cite District of Columbia v Heller, but the interpretation is ongoing between the 2

No. Once it goes into invalidating the constitution, it is no longer state's rights. State's rights involved the state's right to uphold principals of the constitution, not to tear them down. This is because the federal government has a tendency to tear it up, while it is the state's place to resist what the feds do.

Then I hate her even more, for continuing that which I disagree on. precedents do not make the matter correct. The court can be wrong, and I will just see it as continuing to be wrong and the continuation of yet another in a long line of flawed courts, presidents, and congresses. And any attempt to enforce such a thing will result in me growing in more and more hatred at a wrong government growing more and more distant from me.
