  • The Patriot Act makes it legal for government officials to write search warrants for themselves and proceed to search your home. But as the 4th Amendment of the Constitution clearly states, "The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation..."

  • Senator Dodd, I do not think there are any rights I need give up to be safer from terrorist threats. Not only do we enable terrible abuses of power by giving up rights to "fight" terrorism, there is a law of rapidly diminishing returns. A full surveillance society requires so much work that the only real result is a patchwork of easily-violated laws that can be enforced at a whim, basically returning us to an era predating the rule of law.

    FYI, Republicans wanted to renew S-CHIP with increased funding. Then Democrats started defining poor children to include 25 year olds, and those in families with income levels 4x the poverty level. Congressional Democrats admit S-CHIP is their first step to nationalized healthcare.

  • That is exactly right-both parties use the Constitution as a crutch when it suits their purpose and ignore when it doesn't.

    Every legislative session in the House and Senate a bill is proposed to require all legislation to cite the specific part of the Constitution that allows the proposed law. That idea is derailed every time by sending it to some obscure committee for review where it dies.

    Supporting passage of that single bill would be a great place to start reclaiming our government.

  • I don't disagree with that, but it's ultimately in the hands of the courts to determine the scope of power of the legislature and the President. But then, judicial review itself isn't explicit in the constitution.

  • Unfortunately, in the 1960's courts started shifting from reviewing Constitutionality to being activist and making law. Ditto for government agencies with their administrative laws. Congress has abdicated its responsibility for creating laws and "sub-contracted" it to agencies like EPA, HUD, etc.

    Finally, Congress has avoided dealing straight up with controversial issues, knowing that in many instances a lawsuit with be tried before a sympathetic judge and de facto "law" will be created.

    I'm really happy that people are starting to wake up to that fact. They just need to be honest about the fact that Democrats and Republicans are guilty of it. I wouldn't be surprised to learn that a large percentage of people in Congress last read the Constitution in grade school and don't give it a second thought when legislating.

  • Chris Doff is an intellegent man who i belive is a great senator and a great mind in the democratic party. But Why is he running for president. It is clear that from the start he had no chance of winning and his mere presence in the election only takes away time from the candidates that have a chance. I don't mean to insult Senator Dodd, but please drop out of the race, endorse one of the leading candidates, and take your leadership abilitys back to the senate where they are needed.
