@xmpeg You have no idea about the legal procedure. The burden of proof lies on the plaintiff. So it's her responsibility to prove that that the security guard did this on purpose. No need to prove it is an accident. (And actually it can't be proven.) Only when there is sufficient proof showing that the security guard did this intentionally, that guy needs to argue against the proof in order to claim he did it accidentally.
@xmpeg Also, the police can be in charged of the case only when there is sufficient evidence (sufficient evidence doesn't mean the evidence must be able to prove that defendant is guilty.) Otherwise the police has to deal with large amounts of "cases" and that's simply impossible to do so. Moreover, this is an important barrier to prevent someone from abusing the legal prosecution process to disturb someone, etc.
