A little research will show you that everything outlined in the NDAA was already in place, passed into law during the Bush administration, and ruled on already by SCOTUS. All NDAA did was put all these laws in one place for the first time. It DID, however, put in place policies that will speed up hearings for detainees.

It simply restated powers that had already been given the feds through the PATRIOT Act and dozens of amendments and SCOTUS ruling scattered through the last ten years. It also had clauses stating in very specific and certain terms that NOTHING in the bill could be used to over-rule EXISTING law pertaining to the arrest or detention of U.S. citizens. Read the bill as it was passed.
