  • The 'common law' is not some medieval term that should be thrown around to mean more than it does and I think that's where alot of these people are confused. Common law jurisdiction is merely a delineation between a jurisdiction in which courts and judges make the law and civil jurisdictions where it is encoded. That simple.

There is an obnoxious man who seems to think that his limited knowledge of an 800 year old legal document (that has since been almost entirely revoked or replaced by new laws) gives him the right to evade taxes. Unable to find widespread support amoung legal experts, he resorts referencing his discarded archaic laws to avoid paying taxes. How convenient that these laws happen to be so self-serving.

Surely by refusing to "ackowledge" the magistrate, the individual could get away with ANY crime. I find it hard to believe that a small group with no apparent legal expertise has somehow cottoned onto some legal loophole that an entire industry of experts (with decades of experience) haven't found.

  • @nozero1 . the lawyers swear othes to this system of maritime admiralty law. this is the law they study and the law they know. human beings have nothing to do with this form of law. the laws that we must abide by are common law. this has two forms, criminal and civil. if you infringe on someone's rights you are subject to these laws. if you choose to look into the matter instead of assuming you know you would learn common law superceds all legislation. LOOK IT UP.

  • @camcroney I did the bare bones of research and immediately found that lawyers swear to the "Solicitors Code of Conduct", not the "Maritime Admiralty Law". Maritime admiralty law is restricted to naval matters (hence the name). "Civil" is not a branch of Common law, and entirely distinct legal system that is not used in the UK. Common Law can be revoked or repealed by Parliament, so the content of the Magna Carta can be easily superceded.

  • @camcroney Common Law is base around the idea that laws are developed through trials, with judges making decisions based on writ and common sense. Over time though, this method was phased out as it depended on the competancy of the judge. Legislation, as used by parliament, now has far more influence on the trial, and judges have far less freedom. Magistrates, less still.

  • @nozero1 i admit the basis of my knowledge of is far more limited to the lunacy in the US. it has been my understanding that in all matters common law always supercedes any other forms of law. unless you submite to the authority of that court. but maritime admiralty is not restricted to naval matters as it should. it has been impossed on all US courts. it seems obvious that if they were in the wrong they would have been treated as such they were not, so they must have been within their rights

  • @camcroney It's all very complicated, and there are a lot of differences (and similarities) between US and UK law. The reason for what went on this case was that Magistrate courts only deal with minor offenses, and magistrates have strict limits towards what punishments they can dish out. Because of this, things like security and authority are more relaxed than in a Crown court (jury trial). In a crown court they would have come down on the defendant's behaviour like a ton of bricks.

  • @camcroney Plus, magistrates are only volunteers, who usually have only a limited understanding of the law. Because of this, it is harder for them to overrule people who try to defend themselves with references to obscure laws or conditions. A professional judge or barrister has adequate training, and would probably be able to counter the defendant's claims with ease. But as this is a trial about tax evasion, it isn't the kind of case a professional judge would take up.

  • @nozero1 Yes it makes sence once in trial they would never allow any of that in any US court as well. I assumed this to be a hearing as that would be the only place their actions would make sence. If they were already in trial they would have already submited to whatever jurisdiction the court has. In any case this goes to show at what lengths the powers that be have gone to form law in such a way that even those that study it may never fully understand it. how sad.

The Freemen's tactic here is to quote antiquated laws that are largely irrelevant or long recinded, and to ignore the simple, modern, and readily available leglislation. For instance, he keeps referring to the "1890 Admiralty Law", which in reality only applied to overseas colonies and naval affairs, many of which have since gained independence. Even if the Freeman continues to act in contempt of court, he is only delaying the inevitable.

  • @camcroney Nope, but I heard that one of the charges against St. Clair was dropped in regards to him owing money to a pub landlord. It is likely that they settled out of court. It might be worth mentioning that St. Clair has a rather interesting personal history, in that he was a notorious scam artist. He used to sell false titles to Chivalric orders he invented, and even went under many false titles including "reverend", "major" and "lord". (source from "eagar Beaver" at "fake titles .com").

(as is always the case). see they are trying to impose legislation not law and they do not have jurisdiction to do so until you subit to there jurisdiction. the court knew they were acting within their rights and thats how it played out.

  • It really weirds me out that simple questions like "Do you understand?" and requests to approach or stand seem to just be ways of having people give up their right to operate under common law. How is that even possible? It's too subtle, too weasley. It's arcane and symbolic.     it was only 6 months ago that i realised that all courts are maritime courts and its the people going to court that gives the magistrates the power they need through submision or concent ... everyone should be told this so they can arm themselves with the knowlage to regain the souveraine you were born to be.

I couldn't find inalienable (in the version I have) so I would guess - unless someone can correct me - that inalienable is the same what ever the dictionary?? But yeah, I'd overlooked that point. Interestingly, it also defines a PERSON as a human being capable of having rights, as well as being an "artificial person, such as are created and devised by law for the purpose of society and Government".

I've got the 2nd edition as I'd had heard that a few of the "legalese" terms were removed from later versions (urban legend? I dont know) so I got the earliest version I could find, and some of the words I wanted to look up aren't in that one either? whether I went too early, or they are in the first edition, I dont know?

  • @Ulysses1977 im not sure to be honest, i do know blacks 9 is out now though & the most up to date is whats used in courts etc... maybe just try "lienable" or try to connect the dots between un a lien able somehow? :s i thought the human definition was only in earlier versions so id expect it to be in yours but obviously not.

    Yes it is! American courts are corporations and you can assert common law jurisdiction. Watch Freemen in the US videos. 

  • This is so close to home in way of Geographical location that it couldn't get any closer , this is a diamond of a video, as soon i will be standing in one of the magistates courts there are in Gloucester and there is a chance that i could stand before one or all of these very same magistrates, i really want to see part two just for the education. Well done to the layman so far, he's been quality, 5/5 stars, favourited and featured as main video as a little thanks ;)

It is there to bamboozle you, to confuse you....to intimidate you! If you don't know what the "legalese" is how in hell do you know what THEY are even saying to you? THEY COUNT ON THIS!
