just tried it out and I didn't notice anything like that. I wonder if it is some weird digital artifact based on some unique aspect of your playing / gear. Notice it with other guitars at the input?

that's cool he did at a refund at least - yeah, I've had no problems with any BOSS pedals over the years, but I imagine the every now and then everybody's bound to have some issues...and some certainly have more than their fair share.

May be it was your guitar's high output level? In the manual it says 'With some guitars distortion may be produced. Be careful of your guitar's output level'.

great demo  any volume drop, or tone loss in bypass

it's a BOSS pedal, so it's not true bypass - still no major drop or loss
