You seem to forget that the purpose of the Constitution is to restrain the powers of the government.

The "necessary and proper clause" authorizes the Congress to pass laws that are necessary in carrying out duties which are authorized by the Constitution. The 'necessary and proper clause' does not cover EVERYTHING under the sun, only that which is authorized.

In addition, amendments can be unconstitutional if they were not properly ratified.

The constitution was made to improve the powers of central government (see articles of confederation). The constitutional framework was built to restrain the masses - meaning a majority dominated system. Instead there are road blocks by interest groups.

The Necessary and Proper clause doesn't allow everything under the sun (duh), but in this case it does. Alexander Hamilton already won that argument against Jefferson.

Name me an unconstitutional amendment and i'll call it an oxymoron.

The Constitution gave the federal government power, but not the power to control peoples lives and take away their liberty. The Constitution is designed to set up a republic, as it is stated in the pledge of alligence, everyones individual liberty is protected, even from the majority. Just because majority wants something I own, such as my money, they should not be able to take it, because its mine. I have certain property rights that cant be taken away. Democracy is a very loose principle.

The government can make laws and decide on things as long as they dont infringe upon the freedoms of others. Our government has the responsibility to create an army and a navy. Period.
