You give up your right to freedom of speech when employed (on or off duty) if it is sheds a bad light or is deemed unprofessional by your employer. Regardless if Best Buy was mentioned in the video he was eventually identified and it was found out he was a Best Buy employee. An employer's case is strengthened if their policy outlines this. How many government employees, police officers, CEOs, do you see posting videos? They don't because it can effect their jobs should someone be offended.

If you have kids, best to simply not allow them to post videos at all. It will follow them for the rest of their lives--and you know they are not able to censor themselves.

I think a company should be able to fire you based on what you do in social media. However I do think they should have a policy in writing before they go firing people. In this case I think they're over reacting. But since I don't know if they have a policy in place I can't really say much about it.

It might be wrong but it's not a constitutional issue. The Constitution only applies to "government actions". For example a city can't pass a law that would take away you're right of free speech. The Constitution says "Congress shall make no LAW abridging the freedom of speech". BUT a private company can restrict employee's speech however it wants. No right of free speech with your private employer. You or I might not agree with that but that's how the Constitution works.

I agree. I'm only 16 but I've seen it done in our schools. One of my classmates received a 2-day out-of-school-suspension because he had pictures of his class on his facebook page. Phones aren't allowed in school, but this is all after-the-fact.
I built something for a company that took me one year to make and as soon as it went outside into the public i shot video and posted it, the next day it was remove the video or be fired...
I'm definitely with you on not identifying companies or groups or such. I mean, in all of my videos (even the ones that I make for my college courses), I don't mention what college I'm at. ... But that's also for personal safety.

It's a tough rap, but if someone recognized him as an employee of best buy and the vlog was really in bad taste, I think an employer would have some rights in that case. High School kids and college students should be very careful about what they post. Just like in other venues, you are not totally protected by the first amendment when it puts your school in a bad or embarassing situation. And professors, school administrators do check the internet as well as prospective employers of applicants.

I used to work at Old Navy and I don't know if this is a company policy or just one at our store but if we posted anything on Facebook that was deemed innapropriate we could have been fired. I once got in serious trouble for making a video called "You Make Me Sick" it was a video about people who show up to work sick and infect everyone else. I never mentioned the company that I work for but boy did I get in trouble.

I agree. I'm only 16 but I've seen it done in our schools. One of my classmates received a 2-day out-of-school-suspension because he had pictures of his class on his facebook page. Phones aren't allowed in school, but this is all after-the-fact.

hmmm this is interesting. Several ppl I know were fired from their jobs for things that they wrote on their facebook and myspace accounts....things like their job sucks and theur boss sucks. And I kinda agree that you should be respectful of your workplace when posting things online that are viewable to everyone. It could make your boss think that you do not take your job seriously. its a reminder that u should watch what u say online

It's a tough rap, but if someone recognized him as an employee of best buy and the vlog was really in bad taste, I think an employer would have some rights in that case. High School kids and college students should be very careful about what they post. Just like in other venues, you are not totally protected by the first amendment when it puts your school in a bad or embarassing situation. And professors, school administrators do check the internet as well as prospective employers of applicants.

it's unconstitutional. for them to fire him it means they would be denying his right to the first amendment. As long as he did not slander them in any way would make it unconstitutional for them to fire him. There for if they fired him he could sue them for A. privacy fraud cause they had no right to search him down. and B. denying his constitutional rights. this is so wrong on so many levels

I used to work at Old Navy and I don't know if this is a company policy or just one at our store but if we posted anything on Facebook that was deemed innapropriate we could have been fired. Now I don't ever post naughty things so I didn't worry but a lot of people were upset b/c of this. They also searched us and our bags before we left to make sure we didn't steal anything, which to be honest I was more offended by. But I feel that you are right Nalts this is totally wrong! Freedom of speech!

Actually, they'd probably get less or better press if they simply ignored the whole thing. Companies tend to overreact, making things worse for themselves. To your question, as long as the guy doesn't "out" himself, or trash his employer, he should be immune.

I don't shop at Best Buy...Fry's is closer and a much better shop. The only harassment I get from there is them trying to "sell" me a credit card. I'm not a Best Buy fan, and if I can avoid them I will. Anyway if we are outside of school/work and we aren't doing anything stupid (and/or illegal), we shouldn't get in trouble for things we do on the internet.

My current employer was really impressed with my videos, but from time to time I still enjoy uploading dumb things, but they won't cost me my job.
