You give up your right to freedom of speech when employed (on or off duty) if it is sheds a bad light or is deemed unprofessional by your employer. Regardless if Best Buy was mentioned in the video he was eventually identified and it was found out he was a Best Buy employee. An employer's case is strengthened if their policy outlines this. How many government employees, police officers, CEOs, do you see posting videos? They don't because it can effect their jobs should someone be offended.

Most all HR depts check out employees and job applicants, now. And as Google seeks to improve its facial recognition softwares, even hiding behind online aliases will not be of much use.

If you have kids, best to simply not allow them to post videos at all. It will follow them for the rest of their lives--and you know they are not able to censor themselves.

You could try to pass privacy acts but that won't prevent employers from peeking anyway.

I think a company should be able to fire you based on what you do in social media. However I do think they should have a policy in writing before they go firing people. In this case I think they're over reacting. But since I don't know if they have a policy in place I can't really say much about it.

I think its a little asinine, I saw that video weeks ago and its great, its just talks about how stubborn people are and what they will do for just a brand name regardless of what it can or cant do. Any time an employee does something that could hurt their employer's bottom line they are also hurting themselves. Less revenue coming in means less money for employee bonuses or raises (because let's face it, the loss won't be coming out of the shareholder's bottom line) But while I think what Brian did was ill-advised, I don't like the ramifications for the rest of us in terms of what kind of control an employer should have over our private actions.

Surprisingly enough, something far worse happened to a friend of mine on here Dave (Clownloch). He spoke about his job, possibly parody, possibly true, never identified anyone by name, nor his employer by company name and was fired last week. He was pretty poor, living paycheck to paycheck and now has nowhere to go. So YouTube videos can definitely cost you your job. Be careful!!

It might be wrong but it's not a constitutional issue. The Constitution only applies to "government actions". For example a city can't pass a law that would take away you're right of free speech. The Constitution says "Congress shall make no LAW abridging the freedom of speech". BUT a private company can restrict employee's speech however it wants. No right of free speech with your private employer. You or I might not agree with that but that's how the Constitution works.

It's a tough rap, but if someone recognized him as an employee of best buy and the vlog was really in bad taste, I think an employer would have some rights in that case. High School kids and college students should be very careful about what they post. Just like in other venues, you are not totally protected by the first amendment when it puts your school in a bad or embarassing situation. And professors, school administrators do check the internet as well as prospective employers of applicants.

I used to work at Old Navy and I don't know if this is a company policy or just one at our store but if we posted anything on Facebook that was deemed innapropriate we could have been fired. Now I don't ever post naughty things so I didn't worry but a lot of people were upset b/c of this.
