The first job I ever had was in fast food, and I was a skinny, 15 year old kid......if two people jumped over the counter to attack me, you bet your ass I'd have grabbed a weapon, and yes, I would have kept swinging it until they stayed down. That was 20 years ago though, and people weren't as angry and crazy as they are today. This man was spot-on, criminal record or not. I can't believe he even had to face a grand jury for this.

In Canada he would certainly have been charged with assault. He used excessive force since once his two attackers were down and to all intents and purposes not threatening nor resisting anymore from what we can logically presume from the McDonald's employee's demeanour, facial expression and actions then he applied excessive force in defending himself. In the USA this seems to be historically since the 1870's okay. If someone threatens you with bodily harm you can shoot them.

I agree that he seemed to be overdoing it, however, the amount of force he can use depends on the law of the state. In NY, the court would consider what another would do in a like situation as well as the circumstances of the employee.
I want to make clear that, in the absence of a reas. belief that aggressor is about to kill/rob/rape/maim you cannot just "blow em' away". The rule is a reasonable degree of force, not necess. a proportionate one. It's up to the jury in the end.
