I guess it's only right to have to get permission to use someone's song, but there's something about an oldie like Can't Touch This that feels like it should be allowed to be used by the public. Oldies should be for the public as long as no money is made from them by the user.
Hollywood executives are trying to push a bill through congress that will virtually take down Tumbler, lots of Facebook, and You Tube. I think the pressure is probably coming from the government crack down. It's a shame that Hollywood money can buy the freedom of the internet.

I was looking for the Can't touch this video and found upon this. Youtube has taken copyright infringement way too far. MC Hammer has already made millions on this song.(he lost it all but that's beside the point) There needs to be a statute of limitations of copyrights, especially for music. To not allow a song to be used in someone's video because an artist owns the song is ridiculous. No one is claiming the song is theirs. They might as well go after little kids singing their covers of songs
free publicity is completely irrelevant, the point is the material was copyrighted and uploaders are using them without the owners consent, youtube has to regulate that because it's illegal, it's the same reason as to why many websites don't allow you to make forums about pirating software
I agree with you 100%. Youtube needs to keep their hands off of what people upload. Copyright infringement issues are often false issues anyway. This is free advertising, and it's about time the people in the boardrooms woke up to that fact, instead of chewing the hands that feed them.

My experience has been how the video was done. If there is just background music that is copyrighted, then the audio will simply be removed (this has happened to me), though if there is a mix of voice, and other sounds, plus a copyrighted music, the video itself will be disabled.
Its; not youtube taking down the videos because they want to. It's the RIAA that is telling youtube to remove the videos or they'll be punished themselves. YouTube is a safe harbor, because this website is user generated content, they're not liable for its content unless they refuse to remove a video if the RIAA tells them to.

When you're in TV shows, you like being paid, correct? Record Labels own about 50% of the artist's income so when they release a CD, they make close to nothing. In addition, everyone pirates music so CD and song sales are not pulling in money. Owning the copyright to their song and receiving royalties from it is about the only way they can make somewhat of a living.
There's always going to be a few that make it bad for everyone else. It's too bad. But you're talented and so you don't needs others' stuff anyway! ;)

Oh, BTW, one of the best (and cutest, IMHO) stationeries I ever made used your song. I loved it from the moment I heard it...about 6 or 7 years ago, and once I had the WAV file, I HAD to use it! I got SO MANY compliments on that stationery. I made an animated gif of a cute little girl singing to her kitty to go with it. I could never find any information about the person who actually sang the song though. (I looked and looked, but even Google didn't have any links to it back then!)
It's the artists' lawyers that talk them into these things, cos the lawyers can make money from lawsuits. Even 'regular' artists are now doing the same thing (or their lawyers are, I should say.) I used to make Outlook Express 'stationeries', using graphics and music, but now it's not worth the work. Even though nobody made money doing them, they wanted to sue us for using their pictures or music (even midis) I had lots of fun for years, but it's (sadly) over now!

Videos created with music as a background is fair use (as long as it's not JUST the entire song as an audio track), and pulling the audio tracks on an obviously fair use is bad faith misuse of the DCMA (Digital Millenium Copyright Act) takedown provision.

Okay: I think that using someone else's work is not fair. However, if it is made clear that it is not yours but belongs to its rightful owner(s) and the purpose is non-profit and merely to share, I believe it should be permitted. As you say, it IS free publicity. I discover lots of bands and artists through Youtube and I've bought their songs. And it's also someone else's work that's put into it, so I think that not all the videos should be pulled. Only those that claim what isn't theirs, etc.

Hey I hear ya! I actually made a video of "Speed and Angels" and I used the song "Dreams" by Van Halen. I was forced to pick some other music that didnt do the video ANY justice. I spent a lot of time editing that piece and WMG. Warner Music Group unfortunately owns the right so the song was muted. I was doing them a favor, MANY youtubers are just starting their musical journey and are discovering this great music for the first time, and could be potential customers.

Well actually it is fair. Of course it's nothing against her or any of you who had a video removed but it is illegal. By using a song in your video that you did not have permission to use you are stealing from the artist. And as an indie filmmaker it's not fair to me either. I have to pay for and get permission from any artist I use a song from. Why should I have to pay while others don't. It may not be fun, but it is fair.

Performance Rights Organizations are the ones forcing youtube to take your videos down.
When you're in TV shows, you like being paid, correct? Record Labels own about 50% of the artist's income so when they release a CD, they make close to nothing. In addition, everyone pirates music so CD and song sales are not pulling in money. Owning the copyright to their song and receiving royalties from it is about the only way they can make somewhat of a living.

NOT MAKING MONEY, of course. This is why I will never buy another music CD. I'll buy the mp3 single. But never the full priced cd.
They told us back in the 80's, that the cost of buying music cd's would be less than tapes because they cost less to produce than a cassette. But that never happened. Why? They seen the profits skyrocket. $

I'm on my third account due to this silliness. i had a burping contest video removed because it had the Revenge of the Nerds burping contest in it as an example. From what I can tell about Fair Use it fell into that. Youtube saw it differently.

I agree with her 100%. The fact that youtube blocks videos with copyrighted songs is ridiculous! Copyrighting is about claiming something to be your own when it's not. Hence the name COPYright. When you have a song someone else did in a video you post, you're not COPYING it, you're USING it! Plus, as she said, it's free publicity!

Oh, BTW, one of the best (and cutest, IMHO) stationeries I ever made used your song. I loved it from the moment I heard it...about 6 or 7 years ago, and once I had the WAV file, I HAD to use it! I got SO MANY compliments on that stationery. I made an animated gif of a cute little girl singing to her kitty to go with it. I could never find any information about the person who actually sang the song though. (I looked and looked, but even Google didn't have any links to it back then!)

It's the artists' lawyers that talk them into these things, cos the lawyers can make money from lawsuits. Even 'regular' artists are now doing the same thing (or their lawyers are, I should say.) I used to make Outlook Express 'stationeries', using graphics and music, but now it's not worth the work. Even though nobody made money doing them, they wanted to sue us for using their pictures or music (even midis) I had lots of fun for years, but it's (sadly) over now!

Videos created with music as a background is fair use (as long as it's not JUST the entire song as an audio track), and pulling the audio tracks on an obviously fair use is bad faith misuse of the DCMA (Digital Millenium Copyright Act) takedown provision.

Okay: I think that using someone else's work is not fair. However, if it is made clear that it is not yours but belongs to its rightful owner(s) and the purpose is non-profit and merely to share, I believe it should be permitted. As you say, it IS free publicity. I discover lots of bands and artists through Youtube and I've bought their songs. And it's also someone else's work that's put into it, so I think that not all the videos should be pulled. Only those that claim what isn't theirs, etc.

Hey I hear ya! I actually made a video of "Speed and Angels" and I used the song "Dreams" by Van Halen. I was forced to pick some other music that didnt do the video ANY justice. I spent a lot of time editing that piece and WMG. Warner Music Group unfortunately owns the right so the song was muted. I was doing them a favor, MANY youtubers are just starting their musical journey and are discovering this great music for the first time, and could be potential customers.

Well actually it is fair. Of course it's nothing against her or any of you who had a video removed but it is illegal. By using a song in your video that you did not have permission to use you are stealing from the artist. And as an indie filmmaker it's not fair to me either. I have to pay for and get permission from any artist I use a song from. Why should I have to pay while others don't. It may not be fun, but it is fair.

i fucking hate it. i found a way to trick the filters though. Just download a program like audacity and speed up tempo by like 4%. I still hope they take down the filters though cuz its a pain to have to do it for every song
